46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to clarity and certainty in the administration and
79 operation of Medicaid.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 32.0231, Human Resources Code, is
1012 amended by adding Subsection (a-1) to read as follows:
1113 (a-1) The commission through the rulemaking process
1214 established by Chapter 2001, Government Code, shall on a
1315 prospective basis determine whether to exclude or limit a benefit
1416 under the medical assistance program, unless the exclusion or
1517 limitation is required by state or federal law.
1618 SECTION 2. Subchapter K, Chapter 544, Government Code, as
1719 effective April 1, 2025, is amended by adding Subsection (j) to
1820 Section 544.0502 to read as follows:
1921 (j) Notwithstanding other law, the office of the inspector
2022 general may not recover under subsection (f) a payment made to a
2123 Medicaid provider as a result of waste or abuse discovered after the
2224 fourth anniversary of the date the payment was made to the provider.
2325 SECTION 3. Section 544.05021, Government Code, as added by
2426 this Act, applies to a payment for which recovery is sought on or
2527 after the effective date of this Act, regardless of the date on
2628 which the payment was made.
2729 SECTION 4. If before implementing any provision of this Act
2830 a state agency determines a waiver or authorization from a federal
2931 agency is necessary for implementation of that provision, the
3032 agency affected by the provision shall request the waiver or
3133 authorization and may delay implementing that provision until the
3234 waiver or authorization is granted.
3335 SECTION 5. This Act takes effect September 1, 2025.
