5	7		AN ACT
6	8		relating to clarity and certainty in the administration and
7	9		operation of Medicaid.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Section 32.0231, Human Resources Code, is
10	12		amended by adding Subsection (a-1) to read as follows:
11	13		(a-1) The commission through the rulemaking process
12	14		established by Chapter 2001, Government Code, shall on a
13	15		prospective basis determine whether to exclude or limit a benefit
14	16		under the medical assistance program, unless the exclusion or
15	17		limitation is required by state or federal law.
16	18		SECTION 2. Subchapter K, Chapter 544, Government Code, as
17	19		effective April 1, 2025, is amended by adding Subsection (j) to
18	20		Section 544.0502 to read as follows:
19	21		(j) Notwithstanding other law, the office of the inspector
20	22		general may not recover under subsection (f) a payment made to a
21	23		Medicaid provider as a result of waste or abuse discovered after the
22	24		fourth anniversary of the date the payment was made to the provider.
23	25		SECTION 3. Section 544.05021, Government Code, as added by
24	26		this Act, applies to a payment for which recovery is sought on or
25	27		after the effective date of this Act, regardless of the date on
26	28		which the payment was made.
27	29		SECTION 4. If before implementing any provision of this Act
28	30		a state agency determines a waiver or authorization from a federal
29	31		agency is necessary for implementation of that provision, the
30	32		agency affected by the provision shall request the waiver or
31	33		authorization and may delay implementing that provision until the
32	34		waiver or authorization is granted.
33	35		SECTION 5. This Act takes effect September 1, 2025.
