77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the determination by a state agency that an area in this
1010 state is a rural area.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 10, Government Code, is
1313 amended by adding Chapter 2063 to read as follows:
1414 CHAPTER 2063. STATE AGENCY DETERMINATION OF AREA AS RURAL
1515 Sec. 2063.001. DEFINITION. In this chapter, "state agency"
1616 means a department, commission, board, office, or other agency in
1717 the executive branch of state government, including a university
1818 system or institution of higher education as defined by Section
1919 61.003, Education Code.
2020 Sec. 2063.002. DETERMINATION THAT AREA IS RURAL. In
2121 addition to any factor prescribed by other law and to the extent
2222 authorized by that law, a state agency shall, when determining
2323 whether an area of this state is a rural area, consider the
2424 following factors:
2525 (1) the economic need of the area, including whether
2626 the area has high unemployment or low median income;
2727 (2) health care accessibility in the area, including
2828 whether the area has limited access to hospitals, doctors, or
2929 mental health services;
3030 (3) infrastructure development of the area, including
3131 whether the area has adequate roads, public transit, or Internet
3232 access; and
3333 (4) access to and quality of education in the area,
3434 including an assessment of student poverty levels, resource
3535 availability, and school funding levels.
3636 SECTION 2. This Act takes effect September 1, 2025.
