88 AN ACT
99 relating to the establishment of a school health and related
1010 services program advisory council.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle E, Title 2, Health and Safety Code, is
1313 amended by adding Chapter 106 to read as follows:
1414 CHAPTER 106. SCHOOL HEALTH AND RELATED SERVICES PROGRAM
1515 ADVISORY COUNCIL
1616 Sec. 106.001. DEFINITIONS. In this chapter:
1717 (1) "Advisory council" means the school health and
1818 related services program advisory council established under this
1919 chapter.
2020 (2) "Agency" means the Texas Education Agency.
2121 (3) "Program" means the school health and related
2222 services program under which certain health-related services
2323 provided through a student's individualized education program are
2424 eligible for Medicaid reimbursement.
2525 Sec. 106.002. COMPOSITION OF COUNCIL. (a) The advisory
2626 council is composed of 13 members as follows:
2727 (1) one agency employee with administrative duties
2828 involving the program;
2929 (2) two commission employees with administrative
3030 duties involving the program;
3131 (3) one superintendent or chief financial officer of a
3232 school district with a student enrollment of at least 5,000
3333 students;
3434 (4) one superintendent or chief financial officer of a
3535 school district eligible for the allotment under Section 48.101(c),
3636 Education Code;
3737 (5) one superintendent or chief financial officer of a
3838 school district eligible for the allotment under Section 48.101(b)
3939 or (d), Education Code;
4040 (6) one special education director employed by a
4141 school district described by Subdivision (3);
4242 (7) one special education director employed by a
4343 school district described by Subdivision (4);
4444 (8) one special education director employed by a
4545 school district described by Subdivision (5);
4646 (9) two persons who are each a parent of a student
4747 eligible for reimbursement under the program;
4848 (10) one member of an advocacy group for children with
4949 special needs; and
5050 (11) one provider of special education services.
5151 (b) The commissioner of education shall appoint the member
5252 described by Subsection (a)(1). The executive commissioner or the
5353 executive commissioner's designee shall:
5454 (1) appoint the remaining 12 members to the advisory
5555 council; and
5656 (2) designate one member as chair of the advisory
5757 council.
5858 (c) An appointment to a vacancy on the advisory council
5959 shall be made in the same manner as the original appointment. A
6060 member is eligible for reappointment.
6161 Sec. 106.003. TERMS. Members of the advisory council serve
6262 staggered four-year terms, with the terms of six or seven members
6363 expiring on August 31 of each odd-numbered year.
6464 Sec. 106.004. REIMBURSEMENT. Members of the advisory
6565 council serve without compensation but are entitled to
6666 reimbursement for travel expenses.
6767 Sec. 106.005. COUNCIL DUTIES; ADVISORY STATUS. (a) The
6868 advisory council shall advise the agency and the commission
6969 regarding:
7070 (1) implementing and administering the program;
7171 (2) incorporating changes to federal law governing the
7272 program; and
7373 (3) any other issue involving the administration of
7474 the program.
7575 (b) Chapter 2110, Government Code, does not apply to the
7676 advisory council.
7777 Sec. 106.006. ADMINISTRATIVE SUPPORT AND FUNDING. (a) The
7878 commission shall provide administrative support for the advisory
7979 council.
8080 (b) Funding for the administrative and operational expenses
8181 of the advisory council shall be provided through legislative
8282 appropriation to the commission for that purpose.
8383 Sec. 106.007. RULES. The executive commissioner may adopt
8484 rules as necessary to implement this chapter.
8585 SECTION 2. As soon as practicable and not later than October
8686 1, 2025, the commissioner of education and the executive
8787 commissioner of the Health and Human Services Commission shall
8888 appoint the members of the school health and related services
8989 program advisory council established under Chapter 106, Health and
9090 Safety Code, as added by this Act, and shall provide for staggered
9191 member terms as required by that chapter.
9292 SECTION 3. This Act takes effect immediately if it receives
9393 a vote of two-thirds of all the members elected to each house, as
9494 provided by Section 39, Article III, Texas Constitution. If this
9595 Act does not receive the vote necessary for immediate effect, this
9696 Act takes effect September 1, 2025.
