88 AN ACT
99 relating to establishing the Historic Texas Cemeteries Designation
1010 Program; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 442, Government Code, is amended by
1313 adding Subchapter I to read as follows:
1414 SUBCHAPTER I. HISTORIC TEXAS CEMETERIES DESIGNATION PROGRAM
1515 Sec. 442.351. DEFINITION. In this subchapter, "program"
1616 means the Historic Texas Cemeteries Designation Program.
1717 Sec. 442.352. ESTABLISHMENT AND PURPOSE. The commission
1818 shall establish the program to alert the public, as well as current
1919 and future owners of land adjacent to a cemetery, of the cemetery's
2020 existence.
2121 Sec. 442.353. ELIGIBILITY. To be eligible for a
2222 designation under the program, a cemetery must:
2323 (1) be worthy of recognition and preservation for the
2424 cemetery's historical associations; and
2525 (2) be established at least 50 years before the date an
2626 application is submitted to the commission to designate the
2727 cemetery under the program, unless the commission determines the
2828 cemetery is exceptionally significant.
2929 Sec. 442.354. APPLYING FOR DESIGNATION. (a) Any person may
3030 submit an application to the commission to designate a cemetery
3131 under the program.
3232 (b) The applicant must include as part of the application
3333 information establishing the existence of the cemetery.
3434 Sec. 442.355. NOTICE OF APPLICATION. (a) After the
3535 commission receives an application to designate a cemetery under
3636 the program, the commission shall notify the following persons of
3737 the application:
3838 (1) the owner of the property containing the cemetery;
3939 (2) each owner of property adjacent to the cemetery;
4040 and
4141 (3) the county historical commission established
4242 under Chapter 318, Local Government Code, for the county in which
4343 the cemetery is located, if applicable.
4444 (b) The commission shall provide a county historical
4545 commission described by Subsection (a)(3) with a copy of the
4646 application materials to designate a cemetery under the program.
4747 Sec. 442.356. APPLICATION REVIEW; DECISION. (a) The
4848 commission shall review each application it receives for
4949 designation of a cemetery under the program and determine whether
5050 the cemetery qualifies for designation under the program.
5151 (b) If the commission determines the cemetery qualifies for
5252 a designation under the program, the commission shall:
5353 (1) approve the application;
5454 (2) notify the applicant of the approval of the
5555 application;
5656 (3) send to the applicant a declaration of dedication
5757 to be filed with the appropriate county clerk's office; and
5858 (4) inform the applicant that the cemetery may be
5959 recognized with an Official Texas Historical Marker available for
6060 purchase from the commission to certify the cemetery's
6161 participation in the program.
6262 (c) A cemetery is officially recognized under the program on
6363 the commission's receipt of a copy of the filed declaration of
6464 dedication described by Subsection (b)(3), including any exhibits
6565 filed with the declaration. The copy of the declaration of
6666 dedication must show the date the declaration was filed and the
6767 recording information for the declaration.
6868 (d) If the commission determines the cemetery does not
6969 qualify for designation under the program, the commission shall
7070 either:
7171 (1) request additional information from the applicant
7272 to support the application; or
7373 (2) deny the application.
7474 (e) If the commission denies the application for
7575 designation under the program, the commission shall notify the
7676 applicant of the denial and inform the applicant of the ability to
7777 appeal the decision to the members of the commission.
7878 Sec. 442.357. APPLICATION FORM; FEE. (a) The commission
7979 shall develop an application form and procedure for applying for a
8080 designation under the program. The application may require any
8181 information the commission considers necessary, including a deed
8282 and title, plot records, archival documents, photographs, oral
8383 histories, and archaeological data.
8484 (b) The commission shall make the application available at
8585 the commission's office or post the application on the commission's
8686 Internet website.
8787 (c) The commission may charge a processing fee not to exceed
8888 $25 for each application submitted under this subchapter.
8989 Sec. 442.358. EFFECT OF DESIGNATION; REMOVAL. (a) A
9090 historic cemetery designation under the program does not restrict
9191 in any way a property owner's use of land outside the designated
9292 cemetery's boundaries.
9393 (b) A historic cemetery designation under the program may be
9494 removed only by:
9595 (1) commission action; or
9696 (2) an order of a court of competent jurisdiction:
9797 (A) removing the designation; or
9898 (B) removing the dedication and returning the
9999 land to other purposes.
100100 (c) A transfer of ownership of property containing a
101101 cemetery designated under the program does not result in a removal
102102 of the designation.
103103 Sec. 442.359. RULES. The commission shall adopt rules as
104104 necessary to implement this subchapter.
105105 SECTION 2. This Act takes effect September 1, 2025.
