| 9 | 9 | | relating to requiring public schools to provide to certain parents |

| 10 | 10 | | notice regarding certain incidents and risks related to the |
|---|
| 11 | 11 | | parent's child and suicide prevention materials. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 37.0832, Education Code, is amended by |
|---|
| 14 | 14 | | adding Subsections (c-2) and (c-3) to read as follows: |
|---|
| 15 | 15 | | (c-2) The procedure for providing notice to a parent or |
|---|
| 16 | 16 | | guardian of an alleged victim of an incident of bullying under |
|---|
| 17 | 17 | | Subsection (c)(4) must include requirements to: |
|---|
| 18 | 18 | | (1) maintain a record that verifies the parent or |
|---|
| 19 | 19 | | guardian was notified of the incident; and |
|---|
| 20 | 20 | | (2) provide the parent or guardian with: |
|---|
| 21 | 21 | | (A) suicide prevention materials; and |
|---|
| 22 | 22 | | (B) information on ways to limit the student's |
|---|
| 23 | 23 | | access to means of committing suicide, including a firearm or |
|---|
| 24 | 24 | | medication. |
|---|
| 25 | 25 | | (c-3) The agency, in coordination with the Health and Human |
|---|
| 26 | 26 | | Services Commission, shall select the materials and information |
|---|
| 27 | 27 | | described by Subsection (c-2)(2). |
|---|
| 28 | 28 | | SECTION 2. Section 38.351, Education Code, is amended by |
|---|
| 29 | 29 | | adding Subsections (e-1) and (e-2) to read as follows: |
|---|
| 30 | 30 | | (e-1) The board of trustees of a school district or the |
|---|
| 31 | 31 | | governing body of an open-enrollment charter school shall adopt a |
|---|
| 32 | 32 | | policy that establishes a procedure for providing notice in |
|---|
| 33 | 33 | | addition to any notice provided in accordance with Subsection |
|---|
| 34 | 34 | | (e)(3) to a parent or guardian of a student who is identified as at |
|---|
| 35 | 35 | | risk of suicide. The procedure must include requirements to: |
|---|
| 36 | 36 | | (1) maintain a record that verifies the parent or |
|---|
| 37 | 37 | | guardian was notified regarding the risk; and |
|---|
| 38 | 38 | | (2) provide the parent or guardian with: |
|---|
| 39 | 39 | | (A) suicide prevention materials; and |
|---|
| 40 | 40 | | (B) information on ways to limit the student's |
|---|
| 41 | 41 | | access to means of committing suicide, including a firearm or |
|---|
| 42 | 42 | | medication. |
|---|
| 43 | 43 | | (e-2) The agency, in coordination with the Health and Human |
|---|
| 44 | 44 | | Services Commission, shall select the materials and information |
|---|
| 45 | 45 | | described by Subsection (e-1)(2). |
|---|
| 46 | 46 | | SECTION 3. This Act applies beginning with the 2025-2026 |
|---|
| 47 | 47 | | school year. |
|---|
| 48 | 48 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2025. |
