77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring public schools to provide to certain parents
1010 notice regarding certain incidents and risks related to the
1111 parent's child and suicide prevention materials.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 37.0832, Education Code, is amended by
1414 adding Subsections (c-2) and (c-3) to read as follows:
1515 (c-2) The procedure for providing notice to a parent or
1616 guardian of an alleged victim of an incident of bullying under
1717 Subsection (c)(4) must include requirements to:
1818 (1) maintain a record that verifies the parent or
1919 guardian was notified of the incident; and
2020 (2) provide the parent or guardian with:
2121 (A) suicide prevention materials; and
2222 (B) information on ways to limit the student's
2323 access to means of committing suicide, including a firearm or
2424 medication.
2525 (c-3) The agency, in coordination with the Health and Human
2626 Services Commission, shall select the materials and information
2727 described by Subsection (c-2)(2).
2828 SECTION 2. Section 38.351, Education Code, is amended by
2929 adding Subsections (e-1) and (e-2) to read as follows:
3030 (e-1) The board of trustees of a school district or the
3131 governing body of an open-enrollment charter school shall adopt a
3232 policy that establishes a procedure for providing notice in
3333 addition to any notice provided in accordance with Subsection
3434 (e)(3) to a parent or guardian of a student who is identified as at
3535 risk of suicide. The procedure must include requirements to:
3636 (1) maintain a record that verifies the parent or
3737 guardian was notified regarding the risk; and
3838 (2) provide the parent or guardian with:
3939 (A) suicide prevention materials; and
4040 (B) information on ways to limit the student's
4141 access to means of committing suicide, including a firearm or
4242 medication.
4343 (e-2) The agency, in coordination with the Health and Human
4444 Services Commission, shall select the materials and information
4545 described by Subsection (e-1)(2).
4646 SECTION 3. This Act applies beginning with the 2025-2026
4747 school year.
4848 SECTION 4. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2025.
