| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 48, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 48.014 to read as follows: |
|---|
| 14 | 14 | | Sec. 48.014. FEDERAL EDUCATION BLOCK GRANTS; REPORT. (a) |
|---|
| 15 | 15 | | Notwithstanding any other law, a federal education block grant may |
|---|
| 16 | 16 | | not be allocated, spent, or transferred except as specifically |
|---|
| 17 | 17 | | authorized by the legislature by appropriation or other general |
|---|
| 18 | 18 | | law. |
|---|
| 19 | 19 | | (b) The agency shall submit an annual report to the |
|---|
| 20 | 20 | | legislature regarding the use of federal education block grants |
|---|
| 21 | 21 | | during the preceding school year. The report must include |
|---|
| 22 | 22 | | information regarding the effect of the manner in which the block |
|---|
| 23 | 23 | | grants were allocated on education in this state, including any |
|---|
| 24 | 24 | | progress toward reducing educational disparities or improving |
|---|
| 25 | 25 | | student achievement. |
|---|
| 26 | 26 | | SECTION 2. Section 317.003, Government Code, is amended by |
|---|
| 27 | 27 | | amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 28 | 28 | | follows: |
|---|
| 29 | 29 | | (b) Except as provided by Section 317.005(f), a proposal may |
|---|
| 30 | 30 | | provide for the withholding of appropriations made from funds |
|---|
| 31 | 31 | | dedicated by statute to a specific state agency or for a specific |
|---|
| 32 | 32 | | purpose and may provide for the transfer of appropriations made |
|---|
| 33 | 33 | | from statutorily dedicated funds to an agency or for a purpose not |
|---|
| 34 | 34 | | authorized by the statute. Funds dedicated by the Texas |
|---|
| 35 | 35 | | Constitution are subject to being withheld under this chapter but |
|---|
| 36 | 36 | | are not subject to transfer except to another state agency entitled |
|---|
| 37 | 37 | | to receive appropriations from the funds under the terms of the |
|---|
| 38 | 38 | | constitution. Subject to Subsection (b-1), federal [Federal] funds |
|---|
| 39 | 39 | | appropriated by the legislature are subject to being withheld under |
|---|
| 40 | 40 | | this chapter but may not be transferred except as permitted by |
|---|
| 41 | 41 | | federal law. |
|---|
| 42 | 42 | | (b-1) A federal education block grant may not be withheld or |
|---|
| 43 | 43 | | transferred under, or otherwise affected by, this chapter. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2025. |
