88 AN ACT
99 relating to restrictions on certain contributions and lobbyist
1010 compensation by persons appointed to public office by the governor;
1111 creating a criminal offense.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 601, Government Code, is amended by
1414 adding Section 601.010 to read as follows:
1515 Sec. 601.010. CERTAIN DONORS INELIGIBLE FOR GUBERNATORIAL
1616 APPOINTMENTS; CONTRIBUTIONS AND LOBBYIST COMPENSATION BY
1717 GUBERNATORIAL APPOINTEES RESTRICTED; CRIMINAL OFFENSE. (a) In
1818 this section:
1919 (1) "Communicates directly with," "matter," "member
2020 of the executive branch," and "member of the legislative branch"
2121 have the meanings assigned by Section 305.002.
2222 (2) "Political contribution" and "specific-purpose
2323 committee" have the meanings assigned by Section 251.001, Election
2424 Code.
2525 (b) An individual is ineligible to serve as an officer
2626 appointed by the governor if during the year preceding the date of
2727 appointment the individual made political contributions that in the
2828 aggregate exceeded $2,500 to:
2929 (1) the governor; or
3030 (2) a specific-purpose committee supporting the
3131 governor as a candidate or assisting the governor as an
3232 officeholder.
3333 (c) An individual serving as an officer appointed by the
3434 governor may not during any single year in which the individual
3535 serves in that office make political contributions that in the
3636 aggregate exceed $2,500 to:
3737 (1) the governor; or
3838 (2) a specific-purpose committee supporting the
3939 governor as a candidate or assisting the governor as an
4040 officeholder.
4141 (d) For purposes of Subsection (b) and (c), a political
4242 contribution made by the spouse or dependent child of an individual
4343 or a political contribution from an organization made in the
4444 individual's name and with the individual's consent is considered
4545 to be a contribution made by the individual.
4646 (e) An individual who violates Subsection (b) or (c) is
4747 liable for damages to this state in an amount equal to three times
4848 the amount of the contributions made in violation of those
4949 subsections.
5050 (f) Before taking office, an individual appointed by the
5151 governor must sign an attestation that during the year preceding
5252 the appointment the individual, the individual's spouse or
5353 dependent child, or an organization in the individual's name and
5454 with the individual's consent did not make political contributions
5555 exceeding $2,500 to the governor or a specific-purpose committee
5656 supporting the governor as a candidate or assisting the governor as
5757 an officeholder.
5858 (g) Before taking office, an individual appointed by the
5959 governor must sign an attestation that the individual or a business
6060 entity acting at the direction of the individual will not
6161 compensate a person required to register as a lobbyist under
6262 Chapter 305 for communicating directly with a member of the
6363 legislative or executive branch on a matter affecting the
6464 individual's state agency and will comply with any political
6565 contribution limits under Subsection (b). An individual appointed
6666 by the governor who violates an attestation under this subsection,
6767 a business entity acting at the direction of the individual that
6868 violates an attestation under this subsection, or a person required
6969 to register as a lobbyist under Chapter 305 who accepts
7070 compensation made in violation of an attestation under this
7171 subsection commits an offense. An offense under this subsection is
7272 a Class A misdemeanor.
7373 SECTION 2. Section 601.010, Government Code, as added by
7474 this Act, applies only to an appointment made on or after the
7575 effective date of this Act.
7676 SECTION 3. This Act takes effect September 1, 2025.
