77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a political subdivision to establish
1010 and operate a guaranteed income program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 140, Local Government Code, is amended
1313 by adding Section 140.014 to read as follows:
1414 Sec. 140.014. PROHIBITION ON GUARANTEED INCOME PROGRAM.
1515 (a) In this section, "guaranteed income program" means a program
1616 under which an individual is issued an unconditional cash payment
1717 on a regular basis to be used by the individual for any purpose. The
1818 term does not include a program under which an individual is
1919 required to seek employment, perform work, or attend career or job
2020 training as a condition of receiving a payment.
2121 (b) Unless explicitly authorized by law, a political
2222 subdivision may not adopt or enforce an ordinance, order,
2323 regulation, or other measure that establishes or provides for the
2424 operation of a guaranteed income program.
2525 SECTION 2. Notwithstanding Section 140.014, Local
2626 Government Code, as added by this Act, an ordinance, order,
2727 regulation, or other measure that establishes or provides for the
2828 operation of a guaranteed income program, as defined by that
2929 section, in effect before the effective date of this Act may be
3030 enforced until the earlier of January 1, 2026, or the expiration of
3131 the ordinance, order, regulation, or other measure.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2025.
