68 relating to certain authorities of the adjutant general for

810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter A, Chapter 437, Government Code, is
1012 amended by adding Section 437.054 to read as follows:
1113 Sec. 437.054. ADJUTANT GENERAL: GENERAL POWERS. (a) The
1214 adjutant general is the decision-making authority on all matters
1315 concerning the location and maintenance of military forces and
1416 facilities in this state. The adjutant general may set priorities
1517 for the construction, renovation, repair, and maintenance of Texas
1618 military forces armories, facilities, and improvements owned or
1719 leased by this state. The adjutant general in this capacity is a
1820 public authority and a body politic and corporate and has all powers
1921 necessary for the acquisition,and procurement related to
2022 construction, construction, rental, control, maintenance,
2123 operation, and disposition of Texas military forces facilities and
2224 real property and all associated property and equipment.
2325 (b) The adjutant general may execute the cooperative
2426 agreements with the National Guard Bureau and an interagency
2527 military agreement with a federal, state, or local governmental or
2628 quasi-governmental agency.
2729 (c) The adjutant general may delegate the authority granted
2830 under this section in whole or in part.
2931 SECTION 2. This Act takes effect September 1, 2025.
