8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Subchapter A, Chapter 437, Government Code, is |

10 | 12 | | amended by adding Section 437.054 to read as follows: |

11 | 13 | | Sec. 437.054. ADJUTANT GENERAL: GENERAL POWERS. (a) The |
---|
12 | 14 | | adjutant general is the decision-making authority on all matters |
---|
13 | 15 | | concerning the location and maintenance of military forces and |
---|
14 | 16 | | facilities in this state. The adjutant general may set priorities |
---|
15 | 17 | | for the construction, renovation, repair, and maintenance of Texas |
---|
16 | 18 | | military forces armories, facilities, and improvements owned or |
---|
17 | 19 | | leased by this state. The adjutant general in this capacity is a |
---|
18 | 20 | | public authority and a body politic and corporate and has all powers |
---|
19 | 21 | | necessary for the acquisition,and procurement related to |
---|
20 | 22 | | construction, construction, rental, control, maintenance, |
---|
21 | 23 | | operation, and disposition of Texas military forces facilities and |
---|
22 | 24 | | real property and all associated property and equipment. |
---|
23 | 25 | | (b) The adjutant general may execute the cooperative |
---|
24 | 26 | | agreements with the National Guard Bureau and an interagency |
---|
25 | 27 | | military agreement with a federal, state, or local governmental or |
---|
26 | 28 | | quasi-governmental agency. |
---|
27 | 29 | | (c) The adjutant general may delegate the authority granted |
---|
28 | 30 | | under this section in whole or in part. |
---|
29 | 31 | | SECTION 2. This Act takes effect September 1, 2025. |
