77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the enforceability of certain state agency and local
1010 government contract language regarding required security incident
1111 notifications.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2054.603, Government Code, is amended by
1414 adding Subsection (e) to read as follows:
1515 (e) Contract language in a cybersecurity insurance contract
1616 or other contract for goods or services prohibiting or restricting
1717 a state agency's or local government's compliance with this section
1818 or otherwise circumventing the requirements of this section is void
1919 and unenforceable.
2020 SECTION 2. Section 2054.603(e), Government Code, as added
2121 by this Act, is intended to clarify rather than change existing law.
2222 SECTION 3. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2025.
