12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 2054.603, Government Code, is amended by | |
14 | 14 | adding Subsection (e) to read as follows: | |
15 | 15 | (e) Contract language in a cybersecurity insurance contract | |
16 | 16 | or other contract for goods or services prohibiting or restricting | |
17 | 17 | a state agency's or local government's compliance with this section | |
18 | 18 | or otherwise circumventing the requirements of this section is void | |
19 | 19 | and unenforceable. | |
20 | 20 | SECTION 2. Section 2054.603(e), Government Code, as added | |
21 | 21 | by this Act, is intended to clarify rather than change existing law. | |
22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2025. |
