| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Subchapter A, Chapter 5, Property Code, is |

| 10 | 12 | | amended by adding Section 5.0131 to read as follows: |

| 11 | 13 | | Sec. 5.0131. SELLER'S DISCLOSURE OF WATER SERVICE: CERTAIN |
|---|
| 12 | 14 | | COUNTIES. (a) This section applies only to an executory contract |
|---|
| 13 | 15 | | for the purchase of a lot that is five acres or less in a county |
|---|
| 14 | 16 | | that: |
|---|
| 15 | 17 | | (1) contains a municipality with a population of more |
|---|
| 16 | 18 | | than 500,000; and |
|---|
| 17 | 19 | | (2) is adjacent to an international border. |
|---|
| 18 | 20 | | (b) Before an executory contract to which this section |
|---|
| 19 | 21 | | applies is signed by the purchaser, the seller shall provide to the |
|---|
| 20 | 22 | | purchaser a written statement that specifies whether the property |
|---|
| 21 | 23 | | currently has water service. |
|---|
| 22 | 24 | | (c) A statement under Subsection (b) must be printed in both |
|---|
| 23 | 25 | | English and Spanish in 14-point bold-face type or in 14-point |
|---|
| 24 | 26 | | capital letters. |
|---|
| 25 | 27 | | (d) If an executory contract is entered into without the |
|---|
| 26 | 28 | | seller providing the statement required by this section, the |
|---|
| 27 | 29 | | purchaser may terminate the contract for any reason within the |
|---|
| 28 | 30 | | earlier of: |
|---|
| 29 | 31 | | (1) seven days after the date the purchaser receives |
|---|
| 30 | 32 | | the notice; or |
|---|
| 31 | 33 | | (2) the date the transfer occurs as provided by the |
|---|
| 32 | 34 | | executory contract. |
|---|
| 33 | 35 | | SECTION 2. This Act takes effect September 1, 2025. |
