57 AN ACT
68 relating to a seller's notice regarding the connection of water
79 utilities to certain tracts of land.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter A, Chapter 5, Property Code, is
1012 amended by adding Section 5.0131 to read as follows:
1113 Sec. 5.0131. SELLER'S DISCLOSURE OF WATER SERVICE: CERTAIN
1214 COUNTIES. (a) This section applies only to an executory contract
1315 for the purchase of a lot that is five acres or less in a county
1416 that:
1517 (1) contains a municipality with a population of more
1618 than 500,000; and
1719 (2) is adjacent to an international border.
1820 (b) Before an executory contract to which this section
1921 applies is signed by the purchaser, the seller shall provide to the
2022 purchaser a written statement that specifies whether the property
2123 currently has water service.
2224 (c) A statement under Subsection (b) must be printed in both
2325 English and Spanish in 14-point bold-face type or in 14-point
2426 capital letters.
2527 (d) If an executory contract is entered into without the
2628 seller providing the statement required by this section, the
2729 purchaser may terminate the contract for any reason within the
2830 earlier of:
2931 (1) seven days after the date the purchaser receives
3032 the notice; or
3133 (2) the date the transfer occurs as provided by the
3234 executory contract.
3335 SECTION 2. This Act takes effect September 1, 2025.
