77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to minimum staffing standards and policies for assisted
1010 living facilities that provide care to persons with Alzheimer's
1111 disease or related disorders and to the disclosure of those
1212 standards and policies.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 247.029, Health and Safety Code, is
1515 amended by amending Subsection (b) and adding Subsection (b-1) to
1616 read as follows:
1717 (b) The executive commissioner shall adopt minimum
1818 standards for an assisted living facility classified under this
1919 section. The minimum standards must require the facility to:
2020 (1) maintain a minimum staffing ratio of:
2121 (A) for the day shift, one nursing assistant per
2222 seven residents;
2323 (B) for the evening shift, one nursing assistant
2424 per 9.5 residents; and
2525 (C) for the overnight shift, one nursing
2626 assistant per 17 residents;
2727 (2) adopt staffing policies to ensure residents'
2828 needs, as determined by each resident's resident-centered care
2929 plan, are met through direct care by staff at the facility; and
3030 (3) disclose the facility's 24-hour staffing patterns:
3131 (A) to prospective residents and their families;
3232 and
3333 (B) on the facility's Internet website.
3434 (b-1) At least once a month, an assisted living facility
3535 shall post the facility's updated 24-hour staffing pattern
3636 prominently and conspicuously in a public area of the facility that
3737 is readily accessible to residents, employees, and visitors.
3838 SECTION 2. As soon as practicable after the effective date
3939 of this Act, the executive commissioner of the Health and Human
4040 Services Commission shall adopt the minimum standards necessary to
4141 implement the change in law made by this Act.
4242 SECTION 3. This Act takes effect September 1, 2025.
