9 | 9 | | relating to minimum staffing standards and policies for assisted |

10 | 10 | | living facilities that provide care to persons with Alzheimer's |
---|
11 | 11 | | disease or related disorders and to the disclosure of those |
---|
12 | 12 | | standards and policies. |
---|
13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 247.029, Health and Safety Code, is |
---|
15 | 15 | | amended by amending Subsection (b) and adding Subsection (b-1) to |
---|
16 | 16 | | read as follows: |
---|
17 | 17 | | (b) The executive commissioner shall adopt minimum |
---|
18 | 18 | | standards for an assisted living facility classified under this |
---|
19 | 19 | | section. The minimum standards must require the facility to: |
---|
20 | 20 | | (1) maintain a minimum staffing ratio of: |
---|
21 | 21 | | (A) for the day shift, one nursing assistant per |
---|
22 | 22 | | seven residents; |
---|
23 | 23 | | (B) for the evening shift, one nursing assistant |
---|
24 | 24 | | per 9.5 residents; and |
---|
25 | 25 | | (C) for the overnight shift, one nursing |
---|
26 | 26 | | assistant per 17 residents; |
---|
27 | 27 | | (2) adopt staffing policies to ensure residents' |
---|
28 | 28 | | needs, as determined by each resident's resident-centered care |
---|
29 | 29 | | plan, are met through direct care by staff at the facility; and |
---|
30 | 30 | | (3) disclose the facility's 24-hour staffing patterns: |
---|
31 | 31 | | (A) to prospective residents and their families; |
---|
32 | 32 | | and |
---|
33 | 33 | | (B) on the facility's Internet website. |
---|
34 | 34 | | (b-1) At least once a month, an assisted living facility |
---|
35 | 35 | | shall post the facility's updated 24-hour staffing pattern |
---|
36 | 36 | | prominently and conspicuously in a public area of the facility that |
---|
37 | 37 | | is readily accessible to residents, employees, and visitors. |
---|
38 | 38 | | SECTION 2. As soon as practicable after the effective date |
---|
39 | 39 | | of this Act, the executive commissioner of the Health and Human |
---|
40 | 40 | | Services Commission shall adopt the minimum standards necessary to |
---|
41 | 41 | | implement the change in law made by this Act. |
---|
42 | 42 | | SECTION 3. This Act takes effect September 1, 2025. |
