77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of certain persons to provide services
1010 as an employee, volunteer, or contractor for certain agencies,
1111 including public school contractors, and access to the registry of
1212 persons who are not eligible for employment at public schools.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Chapter 810, Health and Safety
1515 Code, is amended to read as follows:
1616 CHAPTER 810. INTERAGENCY REPORTABLE CONDUCT SEARCH ENGINE;
1717 REQUIRED DETERMINATION OF REPORTABLE CONDUCT
1818 SECTION 2. Chapter 810, Health and Safety Code, is amended
1919 by adding Section 810.0055 to read as follows:
2020 Sec. 810.0055. REQUIRED DETERMINATION OF REPORTABLE
2121 CONDUCT. (a) Notwithstanding any other law, a participating state
2222 agency:
2323 (1) shall ensure an investigation is conducted and a
2424 determination is issued for each allegation of reportable conduct
2525 against an agency employee, volunteer, or contractor, regardless of
2626 whether the employee, volunteer, or contractor voluntarily resigns
2727 or surrenders a license or certification the employee, volunteer,
2828 or contractor would otherwise be ineligible to hold as a result of
2929 the determination; and
3030 (2) may not authorize the dismissal of an appeal or
3131 enter into a settlement agreement, through mediation or other
3232 means, related to an allegation of reportable conduct against an
3333 agency employee, volunteer, or contractor if the dismissal or
3434 agreement would prevent issuance of a determination on the
3535 allegation.
3636 (b) A participating state agency shall ensure each
3737 individual the agency determines has engaged in reportable conduct
3838 in accordance with this section is included in the search engine as
3939 required by this chapter.
4040 SECTION 3. Sections 22.0834(a) and (o), Education Code, are
4141 amended to read as follows:
4242 (a) This [Except as provided by Subsection (a-1), this]
4343 subsection applies to a person who is not an applicant for or holder
4444 of a certificate under Subchapter B, Chapter 21, and who is offered
4545 employment by an entity or a subcontractor of an entity that
4646 contracts with a school district, open-enrollment charter school,
4747 or shared services arrangement to provide services, if:
4848 (1) the employee or applicant has or will have
4949 continuing duties related to the contracted services; and
5050 (2) the employee or applicant has or will have direct
5151 contact with students.
5252 (o) A school district, charter school, regional education
5353 service center, commercial transportation company, education
5454 shared services arrangement, or qualified school contractor,
5555 contracting entity, or subcontracting entity may not permit an
5656 employee to whom Subsection (a) applies to provide services at a
5757 school if the employee:
5858 (1) has been convicted of a felony or misdemeanor
5959 offense that would prevent a person from being employed under
6060 Section 22.085(a); or
6161 (2) is identified as having engaged in misconduct
6262 described by Section 22.093(c)(1)(A) or (B) using the interagency
6363 reportable conduct search engine established under Chapter 810,
6464 Health and Safety Code.
6565 SECTION 4. Section 22.092(d), Education Code, is amended to
6666 read as follows:
6767 (d) The agency shall provide equivalent access to the
6868 registry maintained under this section to:
6969 (1) private schools;
7070 (2) public schools; [and]
7171 (3) nonprofit teacher organizations approved by the
7272 commissioner for the purpose of participating in the tutoring
7373 program established under Section 33.913; and
7474 (4) entities and subcontractors of entities that
7575 contract with a school district, open-enrollment charter school, or
7676 shared services arrangement to provide services.
7777 SECTION 5. The following provisions of the Education Code
7878 are repealed:
7979 (1) Sections 22.0834(a-1) and (l); and
8080 (2) Section 22.0834(p)(2).
8181 SECTION 6. Section 22.0834, Education Code, as amended by
8282 this Act, applies only to a contract entered into on or after the
8383 effective date of this Act.
8484 SECTION 7. This Act takes effect immediately if it receives
8585 a vote of two-thirds of all the members elected to each house, as
8686 provided by Section 39, Article III, Texas Constitution. If this
8787 Act does not receive the vote necessary for immediate effect, this
8888 Act takes effect September 1, 2025.
