88 AN ACT
99 relating to notice and opportunity for public comment for certain
1010 policies adopted or implemented by a state agency.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 10, Government Code, is
1313 amended by adding Chapter 2010 to read as follows:
1414 CHAPTER 2010. PUBLIC NOTICE AND HEARING FOR CERTAIN AGENCY ACTION
1515 Sec. 2010.001. APPLICABILITY OF CHAPTER. This chapter does
1616 not apply to a rule that is subject to the requirements of
1717 Subchapter B, Chapter 2001.
1818 Sec. 2010.002. NOTICE AND OPPORTUNITY FOR PUBLIC COMMENT
1919 FOR CERTAIN POLICIES. (a) Before a state agency may implement or
2020 adopt a policy that affects a procedure or agency action relating to
2121 a private person, the state agency must:
2222 (1) give notice of the agency's intention to adopt the
2323 policy in the same manner that the agency would give notice of the
2424 agency's intent to adopt a rule under Section 2001.023; and
2525 (2) give all interested persons a reasonable
2626 opportunity for public comment in the same manner that the agency
2727 would give interested persons an opportunity to submit data, views,
2828 or arguments under Section 2001.029(a).
2929 (b) A state agency shall consider fully all comments the
3030 agency receives about a proposed policy.
3131 SECTION 2. The changes in law made by this Act apply only to
3232 a policy implemented or adopted on or after the effective date of
3333 this Act.
3434 SECTION 3. This Act takes effect September 1, 2025.
