77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the election for which an application for a ballot to be
1010 voted by mail is requested.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 84.004(a), Election Code, is amended to
1313 read as follows:
1414 (a) A person commits an offense if[:
1515 [(1)] the person signs an application for a ballot to
1616 be voted by mail as a witness for more than one applicant in the same
1717 election[; or
1818 [(2) the person signs an application for annual
1919 ballots by mail as a witness for more than one applicant in the same
2020 calendar year].
2121 SECTION 2. Section 84.007(c), Election Code, is amended to
2222 read as follows:
2323 (c) An [Except as provided by Section 86.0015(b), an]
2424 application may be submitted at any time in the year of the election
2525 for which a ballot is requested, but not later than the close of
2626 regular business in the early voting clerk's office or 12 noon,
2727 whichever is later, on the 11th day before election day unless that
2828 day is a Saturday, Sunday, or legal state or national holiday, in
2929 which case the last day is the first preceding regular business day.
3030 SECTION 3. Section 84.011(a), Election Code, is amended to
3131 read as follows:
3232 (a) The officially prescribed application form for an early
3333 voting ballot must include:
3434 (1) immediately preceding the signature space the
3535 statement: "I certify that the information given in this
3636 application is true, and I understand that giving false information
3737 in this application is a crime.";
3838 (2) a statement informing the applicant of the
3939 offenses prescribed by Sections 84.003 and 84.004;
4040 (3) spaces for entering an applicant's voter
4141 registration number and county election precinct of registration,
4242 with a statement informing the applicant that failure to furnish
4343 that information does not invalidate the application;
4444 (3-a) a space for entering the information required
4545 under Section 84.002(a)(1-a); and
4646 (4) on an application for a ballot to be voted by mail:
4747 (A) a space for an applicant applying on the
4848 ground of absence from the county of residence to indicate the date
4949 on or after which the applicant can receive mail at the address
5050 outside the county;
5151 (B) a space for indicating the fact that an
5252 applicant whose application is signed by a witness cannot make the
5353 applicant's mark and a space for indicating the relationship or
5454 lack of relationship of the witness to the applicant;
5555 (C) a space for entering an applicant's telephone
5656 number, with:
5757 (i) a statement informing the applicant
5858 that failure to furnish that information does not invalidate the
5959 application; and
6060 (ii) a statement prescribed by the
6161 secretary of state explaining the benefits of furnishing that
6262 information, including how that information assists the early
6363 voting clerk;
6464 (D) a space or box for an applicant applying on
6565 the ground of age or disability to indicate that the address to
6666 which the ballot is to be mailed is the address of a facility or
6767 relative described by Section 84.002(a)(3), if applicable;
6868 (E) a space or box for an applicant applying on
6969 the ground of confinement in jail or involuntary civil commitment
7070 to indicate that the address to which the ballot is to be mailed is
7171 the address of a relative described by Section 84.002(a)(4) or (7),
7272 if applicable;
7373 (F) [a space for an applicant applying on the
7474 ground of age or disability to indicate if the application is an
7575 application under Section 86.0015;
7676 [(G)] spaces for entering the signature, printed
7777 name, and residence address of any person assisting the applicant;
7878 (G) [(H)] a statement informing the applicant of
7979 the condition prescribed by Section 81.005; and
8080 (H) [(I)] a statement informing the applicant of
8181 the requirement prescribed by Section 86.003(c).
8282 SECTION 4. Section 84.038, Election Code, is amended to
8383 read as follows:
8484 Sec. 84.038. CANCELLATION EFFECTIVE FOR SINGLE ELECTION.
8585 The cancellation of an application for a ballot to be voted by mail
8686 under Section 84.032(c), (d), or (e) is effective for a single
8787 ballot only and does not cancel the application with respect to a
8888 subsequent runoff election[, including a subsequent election to
8989 which the same application applies under Section 84.001(e) or
9090 86.0015(b)].
9191 SECTION 5. Section 86.0015, Election Code, is repealed.
9292 SECTION 6. The change in law made by this Act in amending
9393 Section 84.004(a), Election Code, applies only to an offense
9494 committed on or after the effective date of this Act. An offense
9595 committed before the effective date of this Act is governed by the
9696 law in effect on the date the offense was committed, and the former
9797 law is continued in effect for that purpose. For purposes of this
9898 section, an offense was committed before the effective date of this
9999 Act if any element of the offense occurred before that date.
100100 SECTION 7. This Act applies only to an application for a
101101 ballot voted by mail submitted on or after January 1, 2026.
102102 SECTION 8. This Act takes effect January 1, 2026.
