77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the information reported by prosecuting attorneys to
1010 the Texas Judicial Council.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 71, Government Code, is
1313 amended by adding Section 71.0354 to read as follows:
1414 Sec. 71.0354. PROSECUTING ATTORNEY INFORMATION. (a) In
1515 this section, "prosecuting attorney" means a county attorney,
1616 district attorney, or criminal district attorney representing this
1717 state in criminal matters before the district or other courts of the
1818 county.
1919 (b) Each prosecuting attorney shall report in the form and
2020 manner prescribed by the council information on:
2121 (1) the categories of criminal offenses prosecuted by
2222 the prosecuting attorney and the number of criminal cases in each
2323 category;
2424 (2) the number of personnel employed by the
2525 prosecuting attorney and whether that number is sufficient to
2626 support the prosecutor's caseload;
2727 (3) the number of times a defendant was released as
2828 provided by Article 17.151, Code of Criminal Procedure; and
2929 (4) the number of electronic notices submitted by the
3030 prosecuting attorney to a court as required by Article
3131 17.027(a)(2), Code of Criminal Procedure.
3232 (c) In prescribing the information to be submitted and form
3333 and manner of submission of the information under Subsection (b),
3434 the council shall consult with:
3535 (1) the Texas District and County Attorneys
3636 Association; and
3737 (2) other interested persons.
3838 SECTION 2. Not later than September 1, 2026, the Texas
3939 Judicial Council shall prescribe the information, and form and
4040 manner of submission, a prosecuting attorney in this state is
4141 required to report under Section 71.0354, Government Code, as added
4242 by this Act.
4343 SECTION 3. This Act takes effect September 1, 2025.
