| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Subchapter Z, Chapter 229, Local Government | |
| 13 | 13 | Code, is amended by adding Section 229.902 to read as follows: | |
| 14 | 14 | Sec. 229.902. AUTHORITY TO REGULATE HORSE-DRAWN CARRIAGES. | |
| 15 | 15 | A municipality may not adopt or enforce an ordinance, regulation, | |
| 16 | 16 | or other measure that prohibits or limits a person from engaging in | |
| 17 | 17 | an activity involving a horse-drawn carriage, regardless of whether | |
| 18 | 18 | the activity is for a business, educational, or entertainment | |
| 19 | 19 | purpose. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2025. |
