11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 548.3011, Transportation Code, is | |
13 | 13 | amended by amending Subsection (b) and adding Subsection (b-1) to | |
14 | 14 | read as follows: | |
15 | 15 | (b) Notwithstanding Subsection (a), this section does not | |
16 | 16 | apply to a vehicle that is a 1996 or newer model that has less than | |
17 | 17 | the greater of: | |
18 | 18 | (1) 50,000 miles; or | |
19 | 19 | (2) the mileage established by commission rule under | |
20 | 20 | Subsection (b-1)(2). | |
21 | 21 | (b-1) Not later than February 1 of each even-numbered year, | |
22 | 22 | the commission shall conduct a study on the impact of increasing the | |
23 | 23 | mileage exemption provided by Subsection (b). Not later than 180 | |
24 | 24 | days after commencing a study under this subsection, the commission | |
25 | 25 | shall: | |
26 | 26 | (1) publish the results of the study on the | |
27 | 27 | department's Internet website; and | |
28 | 28 | (2) adopt a rule increasing the mileage exemption | |
29 | 29 | provided by Subsection (b) to the next nearest 5,000 miles that the | |
30 | 30 | commission finds does not adversely impact the state's air quality | |
31 | 31 | state implementation plan. | |
32 | 32 | SECTION 2. This Act takes effect September 1, 2025. |
