77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the requirement for a motor vehicle emissions test on
1010 resale of certain vehicles.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 548.3011, Transportation Code, is
1313 amended by amending Subsection (b) and adding Subsection (b-1) to
1414 read as follows:
1515 (b) Notwithstanding Subsection (a), this section does not
1616 apply to a vehicle that is a 1996 or newer model that has less than
1717 the greater of:
1818 (1) 50,000 miles; or
1919 (2) the mileage established by commission rule under
2020 Subsection (b-1)(2).
2121 (b-1) Not later than February 1 of each even-numbered year,
2222 the commission shall conduct a study on the impact of increasing the
2323 mileage exemption provided by Subsection (b). Not later than 180
2424 days after commencing a study under this subsection, the commission
2525 shall:
2626 (1) publish the results of the study on the
2727 department's Internet website; and
2828 (2) adopt a rule increasing the mileage exemption
2929 provided by Subsection (b) to the next nearest 5,000 miles that the
3030 commission finds does not adversely impact the state's air quality
3131 state implementation plan.
3232 SECTION 2. This Act takes effect September 1, 2025.
