77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the notice required for an election held by certain
1010 political subdivisions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 4.003, Election Code, is amended by
1313 adding Subsection (c-1) to read as follows:
1414 (c-1) In addition to any other notice given for an election
1515 under this section, notice of an election ordered by an authority,
1616 other than an authority described by Subsection (c), must be posted
1717 on the Internet website of the authority not later than the 62nd day
1818 before election day.
1919 SECTION 2. Section 4.004(b), Election Code, is amended to
2020 read as follows:
2121 (b) The notice of a special election or the election of an
2222 authority that holds nonpartisan elections must also state each
2323 office to be filled or the proposition stating each measure to be
2424 voted on. This subsection does not apply to an election on a
2525 proposed constitutional amendment.
2626 SECTION 3. Section 4.008(a), Election Code, is amended to
2727 read as follows:
2828 (a) Except as provided by Subsection (b), the governing body
2929 of a political subdivision, other than a county, that orders an
3030 election shall deliver notice of the election, including the
3131 location of each polling place, to the county clerk and voter
3232 registrar of each county in which the political subdivision is
3333 located not later than the 75th [60th] day before election day. The
3434 county clerk shall post notice of the election, including the
3535 location of each polling place, on the county's Internet website,
3636 if the county maintains a website, as provided by Section 4.003(b).
3737 SECTION 4. The changes in law made by this Act apply only to
3838 an election ordered on or after the effective date of this Act.
3939 SECTION 5. This Act takes effect September 1, 2025.
