46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the bilingual education allotment under the public
79 school finance system.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Sections 48.105(a) and (b), Education Code, are
1012 amended to read as follows:
1113 (a) For each student in average daily attendance in a
1214 bilingual education or special language program under Subchapter B,
1315 Chapter 29, a district is entitled to an annual allotment equal to
1416 the basic allotment multiplied by:
1517 (1) for an emergent bilingual student, as defined by
1618 Section 29.052:
1719 (A) 0.15 [0.1]; or
1820 (B) 0.25 [0.15] if the student is in a bilingual
1921 education program using a dual language immersion[/one-way or
2022 two-way program] model; and
2123 (2) for a student not described by Subdivision (1),
2224 0.05 if the student is in a bilingual education program using a dual
2325 language immersion[/two-way program] model.
2426 (b) At least 60 [55] percent of the funds allocated under
2527 this section must be used in providing bilingual education or
2628 special language programs under Subchapter B, Chapter 29. A
2729 district's bilingual education or special language allocation may
2830 be used only for:
2931 (1) program and student evaluation;[,]
3032 (2) supplementary instructional materials and
3133 equipment;[,]
3234 (3) staff development and bilingual educator
3335 training;[,]
3436 (4) supplemental staff expenses, excluding base
3537 salaries;[,]
3638 (5) salary supplements for bilingual-certified
3739 teachers, excluding base salaries;[,]
3840 (6) incremental costs associated with providing
3941 smaller class sizes, including salaries for educational aides
4042 serving emergent bilingual students;[,]
4143 (7) recruitment, preparation, and retention
4244 incentives for bilingual educators;[,] and
4345 (8) other supplies and expenses directly required for
4446 quality instruction.
4547 SECTION 2. This Act takes effect September 1, 2025.
