| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Sections 48.105(a) and (b), Education Code, are |
|---|
| 10 | 12 | | amended to read as follows: |
|---|
| 11 | 13 | | (a) For each student in average daily attendance in a |
|---|
| 12 | 14 | | bilingual education or special language program under Subchapter B, |
|---|
| 13 | 15 | | Chapter 29, a district is entitled to an annual allotment equal to |
|---|
| 14 | 16 | | the basic allotment multiplied by: |
|---|
| 15 | 17 | | (1) for an emergent bilingual student, as defined by |
|---|
| 16 | 18 | | Section 29.052: |
|---|
| 17 | 19 | | (A) 0.15 [0.1]; or |
|---|
| 18 | 20 | | (B) 0.25 [0.15] if the student is in a bilingual |
|---|
| 19 | 21 | | education program using a dual language immersion[/one-way or |
|---|
| 20 | 22 | | two-way program] model; and |
|---|
| 21 | 23 | | (2) for a student not described by Subdivision (1), |
|---|
| 22 | 24 | | 0.05 if the student is in a bilingual education program using a dual |
|---|
| 23 | 25 | | language immersion[/two-way program] model. |
|---|
| 24 | 26 | | (b) At least 60 [55] percent of the funds allocated under |
|---|
| 25 | 27 | | this section must be used in providing bilingual education or |
|---|
| 26 | 28 | | special language programs under Subchapter B, Chapter 29. A |
|---|
| 27 | 29 | | district's bilingual education or special language allocation may |
|---|
| 28 | 30 | | be used only for: |
|---|
| 29 | 31 | | (1) program and student evaluation;[,] |
|---|
| 30 | 32 | | (2) supplementary instructional materials and |
|---|
| 31 | 33 | | equipment;[,] |
|---|
| 32 | 34 | | (3) staff development and bilingual educator |
|---|
| 33 | 35 | | training;[,] |
|---|
| 34 | 36 | | (4) supplemental staff expenses, excluding base |
|---|
| 35 | 37 | | salaries;[,] |
|---|
| 36 | 38 | | (5) salary supplements for bilingual-certified |
|---|
| 37 | 39 | | teachers, excluding base salaries;[,] |
|---|
| 38 | 40 | | (6) incremental costs associated with providing |
|---|
| 39 | 41 | | smaller class sizes, including salaries for educational aides |
|---|
| 40 | 42 | | serving emergent bilingual students;[,] |
|---|
| 41 | 43 | | (7) recruitment, preparation, and retention |
|---|
| 42 | 44 | | incentives for bilingual educators;[,] and |
|---|
| 43 | 45 | | (8) other supplies and expenses directly required for |
|---|
| 44 | 46 | | quality instruction. |

| 45 | 47 | | SECTION 2. This Act takes effect September 1, 2025. |
