| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. This Act shall be known as Tiffany's Law. |
|---|
| 13 | 13 | | SECTION 2. The heading to Section 545.0651, Transportation |
|---|
| 14 | 14 | | Code, is amended to read as follows: |
|---|
| 15 | 15 | | Sec. 545.0651. STATE AND MUNICIPAL RESTRICTION ON USE OF |
|---|
| 16 | 16 | | HIGHWAY. |
|---|
| 17 | 17 | | SECTION 3. Section 545.0651(a), Transportation Code, is |
|---|
| 18 | 18 | | amended by adding Subdivision (3) to read as follows: |
|---|
| 19 | 19 | | (3) "Toll project" has the meaning assigned by Section |
|---|
| 20 | 20 | | 372.001. |
|---|
| 21 | 21 | | SECTION 4. Section 545.0651, Transportation Code, is |
|---|
| 22 | 22 | | amended by amending Subsections (b) and (c) and adding Subsection |
|---|
| 23 | 23 | | (b-1) to read as follows: |
|---|
| 24 | 24 | | (b) The commission by order may restrict, by class of |
|---|
| 25 | 25 | | vehicle, through traffic to two or more designated lanes of a |
|---|
| 26 | 26 | | highway. If the lanes to be restricted by the commission are |
|---|
| 27 | 27 | | located within a municipality, the commission shall consult with |
|---|
| 28 | 28 | | the municipality before adopting an order under this section. |
|---|
| 29 | 29 | | (b-1) A municipality by ordinance may: |
|---|
| 30 | 30 | | (1) restrict, by class of vehicle, through traffic to |
|---|
| 31 | 31 | | two or more designated lanes of a highway in the municipality; and |
|---|
| 32 | 32 | | (2) prohibit, by class of vehicle, the use of a toll |
|---|
| 33 | 33 | | project in the municipality. |
|---|
| 34 | 34 | | (c) An order under Subsection (b) or an ordinance under |
|---|
| 35 | 35 | | Subsection (b-1)(1) [(b)] must allow a restricted vehicle to use |
|---|
| 36 | 36 | | any lane of the highway to pass another vehicle and to enter and |
|---|
| 37 | 37 | | exit the highway. |
|---|
| 38 | 38 | | SECTION 5. This Act takes effect September 1, 2025. |
