77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a municipality to restrict the use of
1010 toll roads by certain vehicles.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. This Act shall be known as Tiffany's Law.
1313 SECTION 2. The heading to Section 545.0651, Transportation
1414 Code, is amended to read as follows:
1515 Sec. 545.0651. STATE AND MUNICIPAL RESTRICTION ON USE OF
1616 HIGHWAY.
1717 SECTION 3. Section 545.0651(a), Transportation Code, is
1818 amended by adding Subdivision (3) to read as follows:
1919 (3) "Toll project" has the meaning assigned by Section
2020 372.001.
2121 SECTION 4. Section 545.0651, Transportation Code, is
2222 amended by amending Subsections (b) and (c) and adding Subsection
2323 (b-1) to read as follows:
2424 (b) The commission by order may restrict, by class of
2525 vehicle, through traffic to two or more designated lanes of a
2626 highway. If the lanes to be restricted by the commission are
2727 located within a municipality, the commission shall consult with
2828 the municipality before adopting an order under this section.
2929 (b-1) A municipality by ordinance may:
3030 (1) restrict, by class of vehicle, through traffic to
3131 two or more designated lanes of a highway in the municipality; and
3232 (2) prohibit, by class of vehicle, the use of a toll
3333 project in the municipality.
3434 (c) An order under Subsection (b) or an ordinance under
3535 Subsection (b-1)(1) [(b)] must allow a restricted vehicle to use
3636 any lane of the highway to pass another vehicle and to enter and
3737 exit the highway.
3838 SECTION 5. This Act takes effect September 1, 2025.
