57 AN ACT
68 relating to park land dedication requirements for subdivisions by
79 counties; authorizing a fee.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 232.003, Subchapter A, Local Government
1012 Code, is amended to read as follows:
1113 Sec. 232.003. SUBDIVISION REQUIREMENTS. By an order
1214 adopted and entered in the minutes of the commissioners court, and
1315 after a notice is published in a newspaper of general circulation in
1416 the county, the commissioners court may:
1517 (1) require a right-of-way on a street or road that
1618 functions as a main artery in a subdivision, of a width of not less
1719 than 50 feet or more than 100 feet;
1820 (2) require a right-of-way on any other street or road
1921 in a subdivision of not less than 40 feet or more than 70 feet;
2022 (3) require that the shoulder-to-shoulder width on
2123 collectors or main arteries within the right-of-way be not less
2224 than 32 feet or more than 56 feet, and that the shoulder-to-shoulder
2325 width on any other street or road be not less than 25 feet or more
2426 than 35 feet;
2527 (4) adopt, based on the amount and kind of travel over
2628 each street or road in a subdivision, reasonable specifications
2729 relating to the construction of each street or road;
2830 (5) adopt reasonable specifications to provide
2931 adequate drainage for each street or road in a subdivision in
3032 accordance with standard engineering practices;
3133 (6) require that each purchase contract made between a
3234 subdivider and a purchaser of land in the subdivision contain a
3335 statement describing the extent to which water will be made
3436 available to the subdivision and, if it will be made available, how
3537 and when;
3638 (7) require that the owner of the tract to be
3739 subdivided execute a good and sufficient bond in the manner
3840 provided by Section 232.004;
3941 (8) adopt reasonable specifications that provide for
4042 drainage in the subdivision to:
4143 (A) efficiently manage the flow of stormwater
4244 runoff in the subdivision; and
4345 (B) coordinate subdivision drainage with the
4446 general storm drainage pattern for the area; and
4547 (9) require lot and block monumentation to be set by a
4648 registered professional surveyor before recordation of the plat.;
4749 and
4850 (10) either, based on the size and number of lots
4951 within a subdivision and at the discretion of the commissioners
5052 court:
5153 (A) adopt reasonable specifications for a
5254 parkland dedication to provide parks, trails, or similar open-air
5355 recreational facilities for the residents of the subdivision; or
5456 (B) impose a single fee of equivalent value to a
5557 parkland dedication on the subdivider that the county must use for
5658 parks or similar projects.
5759 SECTION 2. Section 232.025, Subchapter B, Local Government
5860 Code, is amended to read as follows:
5961 Sec. 232.025. SUBDIVISION REQUIREMENTS. By an order
6062 adopted and entered in the minutes of the commissioners court, and
6163 after a notice is published in English and Spanish in a newspaper of
6264 general circulation in the county, the commissioners court shall
6365 for each subdivision:
6466 (1) require a right-of-way on a street or road that
6567 functions as a main artery in a subdivision, of a width of not less
6668 than 50 feet or more than 100 feet;
6769 (2) require a right-of-way on any other street or road
6870 in a subdivision of not less than 40 feet or more than 70 feet;
6971 (3) require that the shoulder-to-shoulder width on
7072 collectors or main arteries within the right-of-way be not less
7173 than 32 feet or more than 56 feet, and that the shoulder-to-shoulder
7274 width on any other street or road be not less than 25 feet or more
7375 than 35 feet;
7476 (4) adopt, based on the amount and kind of travel over
7577 each street or road in a subdivision, reasonable specifications
7678 relating to the construction of each street or road;
7779 (5) adopt reasonable specifications to provide
7880 adequate drainage for each street or road in a subdivision in
7981 accordance with standard engineering practices;
8082 (6) require that each purchase contract made between a
8183 subdivider and a purchaser of land in the subdivision contain a
8284 statement describing how and when water, sewer, electricity, and
8385 and gas services will be made available to the subdivision; and
8486 (7) require that the subdivider of the tract execute a
8587 bond in the manner provided by Section 232.027.; and
8688 (8) either, based on the size and number of lots within
8789 a subdivision and at the discretion of the commissioners court:
8890 (A) adopt reasonable specifications for a
8991 parkland dedication to provide parks, trails, or similar open-air
9092 recreational facilities for the residents of the subdivision; or
9193 (B) impose a single fee of equivalent value to a
9294 parkland dedication on the subdivider that must be used by the
9395 county for parks or similar projects.
9496 SECTION 3. This Act takes effect September 1, 2025.
