57 AN ACT
68 relating to aquifer storage and recovery projects that transect a
79 portion of the Edwards Aquifer.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 27.051(i), Water Code, is amended to
1012 read as follows:
1113 (i) For purposes of this subsection, "Edwards Aquifer" has
1214 the meaning assigned by Section 26.046(a). Except as otherwise
1315 provided by this subsection, the commission may not authorize by
1416 rule or permit an injection well that transects or terminates in the
1517 Edwards Aquifer. The commission by rule or permit may authorize:
1618 (1) injection of groundwater withdrawn from the
1719 Edwards Aquifer;
1820 (2) injections of storm water, flood water, or
1921 groundwater through improved sinkholes or caves located in karst
2022 topographic areas; [or]
2123 (3) injections of water made in accordance with
2224 Section 1.44(e)(3), Chapter 626, Acts of the 73rd Legislature,
2325 Regular Session, 1993; or
2426 (4) an aquifer storage and recovery project that
2527 includes an ASR injection well, as defined under Section 27.151,
2628 that transects the Edwards Aquifer in the area of Williamson County
2729 east of Interstate Highway 35 for the injection of water into a
2830 geologic formation that underlies the Edwards Aquifer.
2931 SECTION 2. Not later than March 1, 2026, the Texas
3032 Commission on Environmental Quality shall adopt rules to implement
3133 Section 27.051(i), Water Code, as amended by this Act.
3234 SECTION 3. This Act takes effect immediately if it receives
3335 a vote of two-thirds of all the members elected to each house, as
3436 provided by Section 39, Article III, Texas Constitution. If this
3537 Act does not receive the vote necessary for immediate effect, this
3638 Act takes effect September 1, 2025.
