77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to orders of nondisclosure for certain victims of
1010 trafficking of persons or compelling prostitution.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 411.0728(a) and (b), Government Code,
1313 are amended to read as follows:
1414 (a) This section applies only to a person:
1515 (1) who is convicted of or placed on deferred
1616 adjudication community supervision for an offense under:
1717 (A) Section 481.115, Health and Safety Code;
1818 (B) Section 481.1151, Health and Safety Code;
1919 (C) Section 481.116, Health and Safety Code;
2020 (D) Section 481.1161, Health and Safety Code;
2121 (E) Section 481.117, Health and Safety Code;
2222 (F) Section 481.118, Health and Safety Code;
2323 (G) Section 481.119(b), Health and Safety Code;
2424 (H) Section 481.120, Health and Safety Code[, if
2525 the offense is punishable under Subsection (b)(1)];
2626 (I) [(B)] Section 481.121, Health and Safety
2727 Code[, if the offense is punishable under Subsection (b)(1)];
2828 (J) [(C)] Section 31.03, Penal Code[, if the
2929 offense is punishable under Subsection (e)(1) or (2)];
3030 (K) Section 31.16, Penal Code;
3131 (L) Section 31.17, Penal Code; or
3232 (M) [(D)] Section 43.02, Penal Code; and
3333 (2) who, if requested by the applicable law
3434 enforcement agency or prosecuting attorney to provide assistance in
3535 the investigation or prosecution of an offense under Section
3636 20A.02, 20A.03, or 43.05, Penal Code, or a federal offense
3737 containing elements that are substantially similar to the elements
3838 of an offense under any of those sections:
3939 (A) provided assistance in the investigation or
4040 prosecution of the offense; or
4141 (B) did not provide assistance in the
4242 investigation or prosecution of the offense due to the person's age
4343 or a physical or mental disability resulting from being a victim of
4444 an offense described by this subdivision.
4545 (b) Notwithstanding any other provision of this subchapter
4646 or Subchapter F, a person described by Subsection (a) who is not
4747 ineligible for an order of nondisclosure under Section
4848 411.074(b)(1)(A), (B), or (C) [satisfies the requirements of
4949 Section 411.074(b)] may petition the court that convicted the
5050 person or placed the person on deferred adjudication community
5151 supervision for an order of nondisclosure of criminal history
5252 record information under this section on the grounds that the
5353 person committed the offense solely as a victim of an offense under
5454 Section 20A.02, 20A.03, or 43.05, Penal Code.
5555 SECTION 2. This Act takes effect September 1, 2025.
