11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Sections 411.0728(a) and (b), Government Code, |
---|
13 | 13 | | are amended to read as follows: |
---|
14 | 14 | | (a) This section applies only to a person: |
---|
15 | 15 | | (1) who is convicted of or placed on deferred |
---|
16 | 16 | | adjudication community supervision for an offense under: |
---|
17 | 17 | | (A) Section 481.115, Health and Safety Code; |
---|
18 | 18 | | (B) Section 481.1151, Health and Safety Code; |
---|
19 | 19 | | (C) Section 481.116, Health and Safety Code; |
---|
20 | 20 | | (D) Section 481.1161, Health and Safety Code; |
---|
21 | 21 | | (E) Section 481.117, Health and Safety Code; |
---|
22 | 22 | | (F) Section 481.118, Health and Safety Code; |
---|
23 | 23 | | (G) Section 481.119(b), Health and Safety Code; |
---|
24 | 24 | | (H) Section 481.120, Health and Safety Code[, if |
---|
25 | 25 | | the offense is punishable under Subsection (b)(1)]; |
---|
26 | 26 | | (I) [(B)] Section 481.121, Health and Safety |
---|
27 | 27 | | Code[, if the offense is punishable under Subsection (b)(1)]; |
---|
28 | 28 | | (J) [(C)] Section 31.03, Penal Code[, if the |
---|
29 | 29 | | offense is punishable under Subsection (e)(1) or (2)]; |
---|
30 | 30 | | (K) Section 31.16, Penal Code; |
---|
31 | 31 | | (L) Section 31.17, Penal Code; or |
---|
32 | 32 | | (M) [(D)] Section 43.02, Penal Code; and |
---|
33 | 33 | | (2) who, if requested by the applicable law |
---|
34 | 34 | | enforcement agency or prosecuting attorney to provide assistance in |
---|
35 | 35 | | the investigation or prosecution of an offense under Section |
---|
36 | 36 | | 20A.02, 20A.03, or 43.05, Penal Code, or a federal offense |
---|
37 | 37 | | containing elements that are substantially similar to the elements |
---|
38 | 38 | | of an offense under any of those sections: |
---|
39 | 39 | | (A) provided assistance in the investigation or |
---|
40 | 40 | | prosecution of the offense; or |
---|
41 | 41 | | (B) did not provide assistance in the |
---|
42 | 42 | | investigation or prosecution of the offense due to the person's age |
---|
43 | 43 | | or a physical or mental disability resulting from being a victim of |
---|
44 | 44 | | an offense described by this subdivision. |
---|
45 | 45 | | (b) Notwithstanding any other provision of this subchapter |
---|
46 | 46 | | or Subchapter F, a person described by Subsection (a) who is not |
---|
47 | 47 | | ineligible for an order of nondisclosure under Section |
---|
48 | 48 | | 411.074(b)(1)(A), (B), or (C) [satisfies the requirements of |
---|
49 | 49 | | Section 411.074(b)] may petition the court that convicted the |
---|
50 | 50 | | person or placed the person on deferred adjudication community |
---|
51 | 51 | | supervision for an order of nondisclosure of criminal history |
---|
52 | 52 | | record information under this section on the grounds that the |
---|
53 | 53 | | person committed the offense solely as a victim of an offense under |
---|
54 | 54 | | Section 20A.02, 20A.03, or 43.05, Penal Code. |
---|
55 | 55 | | SECTION 2. This Act takes effect September 1, 2025. |
