| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Section 54.01, Alcoholic Beverage Code, is |
|---|
| 11 | 13 | | amended to read as follows: |
|---|
| 12 | 14 | | Sec. 54.01. AUTHORIZED ACTIVITIES. (a) The holder of an |
|---|
| 13 | 15 | | out-of-state winery direct shipper's permit may: |
|---|
| 14 | 16 | | (1) sell and deliver wine that is produced or bottled |
|---|
| 15 | 17 | | by the permittee to an ultimate consumer located in the State of |
|---|
| 16 | 18 | | Texas; |
|---|
| 17 | 19 | | (2) dispense free wine for consumption at an event |
|---|
| 18 | 20 | | under Section 54.13; and |
|---|
| 19 | 21 | | (3) collect an event or entrance fee. |
|---|
| 20 | 22 | | (b) A delivery of wine into this state by the holder of an |
|---|
| 21 | 23 | | out-of-state winery direct shipper's permit [Delivery] must be made |
|---|
| 22 | 24 | | by the holder of a carrier permit. |
|---|
| 23 | 25 | | SECTION 2. Chapter 54, Alcoholic Beverage Code, is amended |
|---|
| 24 | 26 | | by adding Section 54.13 to read as follows: |
|---|
| 25 | 27 | | Sec. 54.13. SAMPLING AT TEMPORARY LOCATION. (a) The holder |
|---|
| 26 | 28 | | of an out-of-state winery direct shipper's permit may conduct wine |
|---|
| 27 | 29 | | samplings or tastings at a civic or wine festival, farmers' market, |
|---|
| 28 | 30 | | celebration, or similar event. |
|---|
| 29 | 31 | | (b) The wine provided as a sample or at a tasting under |
|---|
| 30 | 32 | | Subsection (a) must be produced or bottled by the holder of the |
|---|
| 31 | 33 | | out-of-state winery direct shipper's permit. |
|---|
| 32 | 34 | | (c) Sample portions provided at a sampling or tasting event |
|---|
| 33 | 35 | | under Subsection (a) may not exceed one ounce. |
|---|
| 34 | 36 | | (d) A person who receives a sample may not remove the sample |
|---|
| 35 | 37 | | from the premises of the event under Subsection (a). |
|---|
| 36 | 38 | | (e) Wine may legally be transported by the holder of the |
|---|
| 37 | 39 | | out-of-state winery direct shipper's permit or the permit holder's |
|---|
| 38 | 40 | | agent or employee to the premises of the event for the purpose of |
|---|
| 39 | 41 | | providing a sample or a tasting under this section. |
|---|
| 40 | 42 | | (f) The cost of the wine provided for a sampling or tasting |
|---|
| 41 | 43 | | under this section is the responsibility of the holder of the |
|---|
| 42 | 44 | | out-of-state winery direct shipper's permit providing the sampling |
|---|
| 43 | 45 | | or tasting. |
|---|
| 44 | 46 | | (g) The commission may adopt rules to implement this |
|---|
| 45 | 47 | | section. |
|---|
| 46 | 48 | | SECTION 3. This Act takes effect September 1, 2025. |
