| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 472, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 472.0355 to read as follows: |
|---|
| 13 | 13 | | Sec. 472.0355. DESIGNATION OF METROPOLITAN LANE. (a) By a |
|---|
| 14 | 14 | | majority vote of the policy board, a metropolitan planning |
|---|
| 15 | 15 | | organization may designate up to 10 percent of the lane miles of |
|---|
| 16 | 16 | | public highways located within the territorial boundaries of the |
|---|
| 17 | 17 | | organization as metropolitan lanes. |
|---|
| 18 | 18 | | (b) On the designation of a metropolitan lane, a |
|---|
| 19 | 19 | | governmental entity of this state, with the approval of the |
|---|
| 20 | 20 | | governing body having primary jurisdiction over the metropolitan |
|---|
| 21 | 21 | | lane, may implement on the metropolitan lane a project that: |
|---|
| 22 | 22 | | (1) uses transit priority lanes or high occupancy |
|---|
| 23 | 23 | | vehicle lanes or otherwise increases the highway's capacity to |
|---|
| 24 | 24 | | transport people by public transportation, rail, or high-speed |
|---|
| 25 | 25 | | rail; or |
|---|
| 26 | 26 | | (2) optimizes the highway for pedestrians, cyclists, |
|---|
| 27 | 27 | | users of personal mobility devices, or other low-mass, low-speed |
|---|
| 28 | 28 | | road users. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2025. |
