| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 46.02, Penal Code, is amended by adding | |
| 13 | 13 | Subsections (a-9) and (c) and amending Subsection (b) to read as | |
| 14 | 14 | follows: | |
| 15 | 15 | (a-9) A person commits an offense if the person transports a | |
| 16 | 16 | firearm to Mexico with the intent to sell the firearm, or purchases | |
| 17 | 17 | a firearm with the intent to transport the firearm to Mexico for | |
| 18 | 18 | distribution, unless otherwise authorized by federal law. | |
| 19 | 19 | (b) Except as provided by Subsection (c), (d), or (e), an | |
| 20 | 20 | offense under this section is a Class A misdemeanor. | |
| 21 | 21 | (c) An offense under Subsection (a-9) is a state jail | |
| 22 | 22 | felony. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2025. |
