11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. The heading to Section 21.006, Local Government | |
13 | 13 | Code, is amended to read as follows: | |
14 | 14 | Sec. 21.006. ELECTION OF CERTAIN MEMBERS OF [ENTIRE] | |
15 | 15 | GOVERNING BODY UPON APPORTIONMENT. | |
16 | 16 | SECTION 2. Section 21.006, Local Government Code, is | |
17 | 17 | amended by amending Subsection (a) and adding Subsection (c) to | |
18 | 18 | read as follows: | |
19 | 19 | (a) Except as provided by Subsection (c), a [A] municipality | |
20 | 20 | that is divided into districts, wards, or other areas from which | |
21 | 21 | members of its governing body are elected shall elect all members of | |
22 | 22 | the municipality's governing body following each apportionment on | |
23 | 23 | the first uniform election date that allows sufficient time to | |
24 | 24 | comply with any requirements of law. | |
25 | 25 | (c) A municipality that elects one or more members of its | |
26 | 26 | governing body at-large, including the office of mayor, is not | |
27 | 27 | required to hold an election for those positions following | |
28 | 28 | apportionment unless the term of office of the at-large member or | |
29 | 29 | mayor would otherwise expire under applicable law. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2025. |
