77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to paid leave for public officers and employees engaged in
1010 certain military service.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 437.202, Government Code, is amended by
1313 amending Subsections (a), (a-1), and (b) and adding Subsections
1414 (a-2) and (a-3) to read as follows:
1515 (a) Except as provided by Subsections (b) and (c), a person
1616 who is an officer or employee of this state, a municipality, a
1717 county, or another political subdivision of this state and who is a
1818 member of the Texas military forces, a reserve component of the
1919 armed forces, or a member of a state or federally authorized urban
2020 search and rescue team is entitled to a paid leave of absence from
2121 the person's duties on a day on which the person is engaged in
2222 authorized training or duty ordered or authorized by proper
2323 authority for not more than 30 [15] workdays in a fiscal year.
2424 During a leave of absence, the person may not be subjected to loss
2525 of time, efficiency rating, personal time, sick leave, or vacation
2626 time.
2727 (a-1) In addition to the leave provided under Subsection
2828 (a), a person described by Subsection (a) called [to state active
2929 duty] by the governor or another appropriate authority to state
3030 active duty, including service in another state on request of the
3131 governor of another state, in response to a disaster is entitled to
3232 a paid leave of absence from the person's duties for each day the
3333 person is called to active duty during the disaster, including any
3434 required pre-deployment training, pre-deployment temporary duty,
3535 and post-deployment earned military leave and rest and recuperation
3636 as confirmed in writing by the person's commanding officer [not to
3737 exceed seven workdays in a fiscal year]. During a leave of absence
3838 under this subsection, the person may not be subjected to loss of
3939 time, efficiency rating, personal time, sick leave, or vacation
4040 time. For purposes of this subsection, "disaster" has the meaning
4141 assigned by Section 418.004.
4242 (a-2) In addition to the leave provided under Subsection
4343 (a), a person described by Subsection (a) called to deploy for
4444 military duty in support of a contingency, humanitarian, disaster,
4545 or emergency operation or exercise of the United States is entitled
4646 to a paid leave of absence from the person's duties for each day the
4747 person is called to military duty during the operation or exercise,
4848 including any required pre-deployment training, pre-deployment
4949 temporary duty, and post-deployment earned military leave and rest
5050 and recuperation as confirmed in writing by the person's commanding
5151 officer. During a leave of absence under this subsection, the
5252 person may not be subjected to loss of time, efficiency rating,
5353 personal time, sick leave, or vacation time.
5454 (a-3) In addition to the leave provided under Subsection
5555 (a), a person described by Subsection (a) called to initial
5656 enlistment or officer basic training, initial career field or duty
5757 assignment training, or professional military education is
5858 entitled to a paid leave of absence from the person's duties for
5959 each day the person is called to the training, including any earned
6060 military leave at the conclusion of the training. During a leave of
6161 absence under this subsection, the person may not be subjected to
6262 loss of time, efficiency rating, personal time, sick leave, or
6363 vacation time.
6464 (b) An officer or employee of this state is entitled to
6565 carry forward from one fiscal year to the next the net balance of
6666 unused accumulated leave under Subsection (a) that does not exceed
6767 90 [45] workdays.
6868 SECTION 2. This Act takes effect September 1, 2025.
