57 AN ACT
68 relating to resident safety from criminal activity in senior
79 retirement communities.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subtitle B, Title 9, Health and Safety Code, is
1012 amended by adding Chapter 786 to read as follows:
1113 CHAPTER 786. SENIOR RETIREMENT COMMUNITIES
1214 Sec. 786.001. DEFINITIONS. In this chapter:
1315 (1) "Common amenity" means an amenity or service
1416 offered or provided to residents of a multiunit residential
1517 property, including:
1618 (A) concierge services;
1719 (B) a library;
1820 (C) common dining services;
1921 (D) housekeeping services; and
2022 (E) full-time security.
2123 (2) "Resident" means an individual who resides in a
2224 senior retirement community as a unit owner or tenant.
2325 (3) "Senior retirement community" means a residential
2426 community or a portion of a residential community:
2527 (A) described by Section 301.043, Property Code;
2628 (B) that contains not fewer than 20 residential
2729 units in one or more multiunit buildings that are available to rent
2830 or lease; and
2931 (C) that provides common amenities.
3032 (4) "Senior retirement community contract" means a
3133 contract with a resident of a senior retirement community for
3234 providing a common amenity to the resident.
3335 (5) "Unit" means a physical portion of a residential
3436 property designated for separate ownership or occupancy.
3537 Sec. 786.002. EXEMPTIONS. This chapter does not apply to:
3638 (1) a health care institution as defined by Section
3739 74.001, Civil Practice and Remedies Code;
3840 (2) a boarding home facility as defined by Section
3941 260.001 that holds a permit issued under Chapter 260;
4042 (3) a supportive housing facility for elderly
4143 individuals operated under Section 202, the National Housing Act
4244 (12 U.S.C. Section 1701q);
4345 (4) a center for independent living as defined by
4446 Section 702 of the federal Rehabilitation Act of 1973 (29 U.S.C.
4547 Section 796a); or
4648 (5) any other facility that is regulated by the Health
4749 and Human Services Commission or in accordance with rules adopted
4850 by the Centers for Medicare and Medicaid Services.
4951 Sec. 786.003. REQUIREMENTS RELATING TO RESIDENT SAFETY FROM
5052 CRIMINAL ACTIVITY. (a) A senior retirement community shall:
5153 (1) conduct for each retirement community employee a
5254 criminal history record check using the computerized criminal
5355 history system maintained by the Department of Public Safety of the
5456 State of Texas;
5557 (2) disclose in the senior retirement community
5658 contract whether the retirement community requires each business
5759 that will provide services at the retirement community to conduct a
5860 criminal history record check of each of the business's employees
5961 who will provide services at the retirement community; and
6062 (3) maintain a resident safety and communications
6163 policy regarding criminal activity that poses a risk to residents,
6264 which must require the retirement community to send to each
6365 resident and post in a conspicuous manner at a location on the
6466 retirement community premises where the retirement community posts
6567 other community notices a written notice containing information on:
6668 (A) known reports of potential criminal activity
6769 made to law enforcement from or at the retirement community not
6870 later than two business days after the date the report is made or
6971 activity occurs; and
7072 (B) known instances of trespassing at the
7173 retirement community not later than two business days after the
7274 trespassing is reported or occurs.
7375 (b) For purposes of providing notice under the policy
7476 adopted by a senior retirement community under Subsection (a)(3)
7577 relating to a reportable incident described by that subdivision,
7678 the retirement community:
7779 (1) may provide for the removal of the personal
7880 identifying information of an individual who is involved in the
7981 reportable incident to prevent the individual's identification;
8082 and
8183 (2) may not refuse to provide the notice based solely
8284 on concerns related to the disclosure of the individual's personal
8385 identifying information.
8486 (c) A senior retirement community may not be held civilly or
8587 criminally liable for the retirement community's compliance with
8688 Subsection (a)(1) or (3).
8789 (d) A senior retirement community may not:
8890 (1) prevent or inhibit a resident from or penalize a
8991 resident for communicating with a law enforcement officer, social
9092 worker, family member, or other interested person regarding the
9193 safety and security of the retirement community; or
9294 (2) prevent a law enforcement officer or court officer
9395 from entering a common area of the retirement community to conduct a
9496 voluntary interview with a resident as part of an investigation
9597 into criminal activity at the retirement community.
9698 SECTION 2. This Act takes effect September 1, 2025.
