12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Chapter 437, Health and Safety Code, is amended | |
14 | 14 | by adding Section 437.0063 to read as follows: | |
15 | 15 | Sec. 437.0063. SMALL-SCALE BUSINESS PERMIT EXEMPTIONS. (a) | |
16 | 16 | In this section: | |
17 | 17 | (1) "Food producer" has the meaning assigned by | |
18 | 18 | Section 437.020. | |
19 | 19 | (2) "Small-scale business" means a legal entity | |
20 | 20 | established by a farmer or food producer with less than $1.5 million | |
21 | 21 | in annual gross revenue. | |
22 | 22 | (b) The department, a county, or a public health district | |
23 | 23 | may not require a small-scale business to: | |
24 | 24 | (1) obtain, or pay a permitting fee for, more than one | |
25 | 25 | permit to operate a temporary food service establishment; or | |
26 | 26 | (2) obtain a permit or pay a permitting fee to operate | |
27 | 27 | a food service establishment, temporary food service | |
28 | 28 | establishment, or retail food store, if the business is licensed as | |
29 | 29 | a food manufacturer under Subchapter J, Chapter 431. | |
30 | 30 | SECTION 2. This Act takes effect September 1, 2025. |
