| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. This Act shall be known as the Good, the True, |
|---|
| 10 | 12 | | and the Beautiful Act. |
|---|
| 11 | 13 | | SECTION 2. Section 323, Local Government Code is amended by |
|---|
| 12 | 14 | | adding Subchapter E to read as follows: |
|---|
| 13 | 15 | | SUBCHAPTER E. MATERIALS IN COUNTY LIBRARIES |
|---|
| 14 | 16 | | Sec. 323.081. SEXUALLY EXPLICIT MATERIALS (a) In this |
|---|
| 15 | 17 | | section, "sexually explicit material" means any communication, |
|---|
| 16 | 18 | | language, or material, including a written description, |
|---|
| 17 | 19 | | photographic image, video image, or audio file, excluding library |
|---|
| 18 | 20 | | material directly related to required curriculum, as referenced in |
|---|
| 19 | 21 | | Section 28.002, Education Code, that describes or portrays sexual |
|---|
| 20 | 22 | | conduct, as defined by Section 43.25, Penal Code, in a patently |
|---|
| 21 | 23 | | offensive way, as defined by Section 43.21, Penal Code. |
|---|
| 22 | 24 | | (b) A county librarian shall not display sexually explicit |
|---|
| 23 | 25 | | materials in a county library. |
|---|
| 24 | 26 | | SECTION 3. Section 326, Local Government Code is amended by |
|---|
| 25 | 27 | | adding Subchapter F to read as follows: |

| 51 | 53 | | SECTION 5. This Act takes effect September 1, 2025. |
