88 AN ACT
99 relating to Medicaid reimbursement for coordinated specialty care
1010 for first episode psychosis.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1313 is amended by adding Section 32.02463 to read as follows:
1414 Sec. 32.02463. REIMBURSEMENT FOR COORDINATED SPECIALTY
1515 CARE FOR FIRST EPISODE PSYCHOSIS. (a) In this section:
1616 (1) "Coordinated specialty care for first episode
1717 psychosis" means coordinated specialty care and services provided
1818 to an individual who is diagnosed with first episode psychosis,
1919 which may include:
2020 (A) any element of the treatment model included
2121 in the Recovery After an Initial Schizophrenia Episode (RAISE)
2222 early treatment program study conducted by the National Institute
2323 of Mental Health regarding treatment for psychosis, as completed
2424 July 2017, including:
2525 (i) psychotherapy;
2626 (ii) medication management;
2727 (iii) case management;
2828 (iv) family education and support; and
2929 (v) education and employment support;
3030 (B) assertive community treatment as described
3131 by the commission's Texas Resilience and Recovery Utilization
3232 Management Guidelines: Adult Mental Health Services, as updated in
3333 April 2017, or a more recently updated version adopted by the
3434 executive commissioner; and
3535 (C) peer support services, including:
3636 (i) recovery and wellness support;
3737 (ii) mentoring; and
3838 (iii) advocacy.
3939 (2) "First episode psychosis" means the initial onset
4040 of psychosis or symptoms associated with psychosis, caused by:
4141 (A) medical or neurological conditions;
4242 (B) serious mental illness; or
4343 (C) substance use.
4444 (3) "Recipient" means a recipient of medical
4545 assistance.
4646 (b) The commission shall ensure that medical assistance
4747 reimbursement is provided to a provider who provides one or more
4848 services classified as coordinated specialty care for first episode
4949 psychosis to a recipient experiencing first episode psychosis.
5050 (c) A provider is eligible to receive medical assistance
5151 reimbursement for the provision of specialty care for first episode
5252 psychosis to a recipient only if the provider:
5353 (1) has contracted with the commission or a managed
5454 care organization to provide that care; and
5555 (2) provides the care in a manner that adheres to the
5656 fidelity of the applicable treatment model the provider follows.
5757 (d) If a psychiatrist or licensed clinical leader of a
5858 treatment team is credentialed to provide coordinated specialty
5959 care for first episode psychosis under the medical assistance
6060 program, each member of the treatment team serving under the
6161 credentialed psychiatrist or licensed clinical leader is
6262 considered to be credentialed to provide that care.
6363 (e) This section may not be construed to require that a
6464 provider of coordinated specialty care treatment for first episode
6565 psychosis provide every coordinated care service to a recipient in
6666 order to receive medical assistance reimbursement.
6767 SECTION 2. If before implementing any provision of this Act
6868 a state agency determines that a waiver or authorization from a
6969 federal agency is necessary for implementation of that provision,
7070 the agency affected by the provision shall request the waiver or
7171 authorization and may delay implementing that provision until the
7272 waiver or authorization is granted.
7373 SECTION 3. This Act takes effect September 1, 2025.
