10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter A, Chapter 38, Education Code, is | |
12 | 12 | amended by adding Section 38.038 to read as follows: | |
13 | 13 | Sec. 38.038. AVAILABILITY OF MENSTRUAL PRODUCTS. (a) In | |
14 | 14 | this section, "menstrual products" means tampons and sanitary | |
15 | 15 | napkins for use in connection with the menstrual cycle. | |
16 | 16 | (b) Each school district shall make menstrual products | |
17 | 17 | available free of charge in each restroom designated for female | |
18 | 18 | students located on each campus in the district. | |
19 | 19 | (c) A school district may accept from any source donations | |
20 | 20 | of clean and safe menstrual products for purposes of this section. | |
21 | 21 | SECTION 2. This Act applies beginning with the 2025-2026 | |
22 | 22 | school year. | |
23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2025. |
