77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the suspension or revocation of a hotel's or motel's
1010 certificate of occupancy by a municipality for suspected human
1111 trafficking.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 215, Local Government
1414 Code, is amended by adding Section 215.007 to read as follows:
1515 Sec. 215.007. SUSPENSION OR REVOCATION OF HOTEL OR MOTEL
1616 CERTIFICATE OF OCCUPANCY. The governing body of a municipality may
1717 suspend or revoke a certificate of occupancy for a hotel or motel
1818 located in the municipality if:
1919 (1) a law enforcement agency gives notice to the
2020 municipality, or the municipality otherwise learns, that the law
2121 enforcement agency is investigating the hotel or motel for an
2222 offense under Chapter 20A, Penal Code; or
2323 (2) the municipality has reasonable cause to believe
2424 that an offense under Chapter 20A, Penal Code, is being committed at
2525 the hotel or motel.
2626 SECTION 2. This Act takes effect September 1, 2025.
