12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Subchapter A, Chapter 215, Local Government | |
14 | 14 | Code, is amended by adding Section 215.007 to read as follows: | |
15 | 15 | Sec. 215.007. SUSPENSION OR REVOCATION OF HOTEL OR MOTEL | |
16 | 16 | CERTIFICATE OF OCCUPANCY. The governing body of a municipality may | |
17 | 17 | suspend or revoke a certificate of occupancy for a hotel or motel | |
18 | 18 | located in the municipality if: | |
19 | 19 | (1) a law enforcement agency gives notice to the | |
20 | 20 | municipality, or the municipality otherwise learns, that the law | |
21 | 21 | enforcement agency is investigating the hotel or motel for an | |
22 | 22 | offense under Chapter 20A, Penal Code; or | |
23 | 23 | (2) the municipality has reasonable cause to believe | |
24 | 24 | that an offense under Chapter 20A, Penal Code, is being committed at | |
25 | 25 | the hotel or motel. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2025. |
