46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the review of existing boards and commissions under the
79 jurisdiction of the comptroller for continuity and to the repeal of
810 certain committees under the jurisdiction of the comptroller.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. SECTION 1: The purpose of this Act is to improve
1113 the efficiency and effectiveness of operations of the office of the
1214 comptroller.
1315 SECTION 2: Chapter 403, Government Code, is amended by
1416 adding Subchapter U to read as follows:
1517 SUBCHAPTER U. COMPTROLLER REVIEW OF BOARDS AND COMMISSIONS
1618 Sec. 403.701: REVIEW AND REPORT ON BOARDS AND COMMISSIONS
1719 UNDER JURISDICTION OF THE COMPTROLLER: (a) The comptroller shall
1820 review each board and commission, including each committee,
1921 council, group and task force, that is a part of the office of the
2022 comptroller, under the direction of the comptroller, or
2123 administratively attached to the office of the comptroller.
2224 (b) The review shall include an assessment of:
2325 (1) the continuing necessity of each board,
2426 commission, committee, council, group and task force; and
2527 (2) whether each board, commission, committee,
2628 council, group or task force promotes efficient and effective
2729 operations of the office of the comptroller.
2830 (b) The comptroller shall submit a report to the legislature
2931 to identify boards, commissions, committees, councils, groups and
3032 task forces that no longer serve a continuing necessity or promote
3133 efficient and effective operations of the office of the
3234 comptroller.
3335 (c) The comptroller shall submit the report to the
3436 legislature no later than December 1, 2026.
3537 (d) This subchapter expires December 31, 2026.
3638 SECTION 3: Section 403.1041 (e), Government Code, is
3739 amended to read as follows:
3840 (e) The comptroller[, with the advice of and in consultation
3941 with the advisory committee,] may use the earnings of the account
4042 for any investment expense, including to obtain the advice of
4143 appropriate investment consultants for managing the assets in the
4244 account.
4345 SECTION 4: The following provisions are repealed:
4446 (1) Section 403.028(f), Government Code;
4547 (2) Section 403.1042, Government Code; and
4648 (3) Section 403.618, Government Code.
4749 SECTION 5: This Act takes effect immediately if it receives
4850 a vote of two-thirds of all the members elected to each house, as
4951 provided by Section 39, Article III, Texas Constitution. If this
5052 Act does not receive the vote necessary for immediate effect, this
5153 Act takes effect September 1, 2025.
