| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Chapter 250, Local Government Code, is amended | |
| 13 | 13 | by adding Section 250.014 to read as follows: | |
| 14 | 14 | Sec. 250.014. REGULATIONS RELATED TO CONSTRUCTION OF | |
| 15 | 15 | MULTIFAMILY HOUSING IN CERTAIN RESIDENTIAL AREAS. (a) | |
| 16 | 16 | Notwithstanding any other law, a municipality or county may not | |
| 17 | 17 | adopt or enforce an ordinance, order, zoning variance, or other | |
| 18 | 18 | regulation that allows for the construction of a multifamily | |
| 19 | 19 | housing unit in an area that consists predominantly of single | |
| 20 | 20 | family residences. | |
| 21 | 21 | (b) A person aggrieved by a violation of Subsection (a) may | |
| 22 | 22 | bring an action for economic damages or injunctive relief against a | |
| 23 | 23 | municipality or county. | |
| 24 | 24 | (c) A person who prevails in an action under this section is | |
| 25 | 25 | entitled to recover treble damages. | |
| 26 | 26 | (d) Governmental immunity of a municipality or county to | |
| 27 | 27 | suit and from liability is waived to the extent of liability created | |
| 28 | 28 | by this section. | |
| 29 | 29 | SECTION 2. This Act takes effect September 1, 2025. |
