| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 11.122, Water Code, is amended by adding | |
| 13 | 13 | Subsection (b-4) to read as follows: | |
| 14 | 14 | (b-4) The commission may waive a requirement described by | |
| 15 | 15 | Subsection (b-3)(3)(B) or (F) if the commission makes a finding | |
| 16 | 16 | that the waiver would not adversely affect: | |
| 17 | 17 | (1) the environment; or | |
| 18 | 18 | (2) the rights of another person who holds a permit, | |
| 19 | 19 | certified filing, or certificate of adjudication issued under | |
| 20 | 20 | Section 11.323. | |
| 21 | 21 | SECTION 2. This Act applies to an application to amend a | |
| 22 | 22 | water right that is filed with the Texas Commission on | |
| 23 | 23 | Environmental Quality on or after the effective date of this Act or | |
| 24 | 24 | is pending as of the effective date of this Act. | |
| 25 | 25 | SECTION 3. This Act takes effect immediately if it receives | |
| 26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
| 27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
| 28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
| 29 | 29 | Act takes effect September 1, 2025. |
