8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Subchapter B-1, Chapter 264, Family Code, is |
---|
10 | 12 | | amended by adding Section 264.1691, Sec.264.1692, Sec. 264.1693, |
---|
11 | 13 | | Sec. 264.1694, and Sec. 264.1695 to read as follows: |
---|
12 | 14 | | Sec. 264.1691. CHILD PROTECTIVE SERVICES PREVENTION GRANT |
---|
13 | 15 | | PROGRAM. In this section, (a) "community-based, nonprofit |
---|
14 | 16 | | organization" means a community-driven nonprofit organization that |
---|
15 | 17 | | is headquartered in Texas that provides child-centered |
---|
16 | 18 | | preservation services; and |
---|
17 | 19 | | (b) "Grant program" means the child protective services |
---|
18 | 20 | | prevention grant program established under this subchapter. |
---|
19 | 21 | | Sec. 264.1692. ESTABLISHMENT AND ADMINISTRATION OF |
---|
20 | 22 | | PROGRAM. (a) The commission shall establish and administer a child |
---|
21 | 23 | | protective services prevention grant program through which the |
---|
22 | 24 | | commission awards grants to one or more eligible community-based, |
---|
23 | 25 | | nonprofit organizations for preventing, or reducing, incidences of |
---|
24 | 26 | | child abuse and neglect and promoting a child's well-being by: |
---|
25 | 27 | | (1) identifying children who are most at risk for |
---|
26 | 28 | | abuse and neglect before they enter child protective services, |
---|
27 | 29 | | families stand the best chance at staying together, and children |
---|
28 | 30 | | have the best odds for a healthy, productive, and fulfilling life. |
---|
29 | 31 | | (b) The commission shall provide grants to community-based, |
---|
30 | 32 | | nonprofit organizations to focused on an areas of need, not greater |
---|
31 | 33 | | than one-square mile, in a county that is ranked among the five |
---|
32 | 34 | | counties with the highest per capita rates of child abuse and |
---|
33 | 35 | | neglect. |
---|
34 | 36 | | Sec. 264.1693. APPLICATION AND ELIGIBILITY REQUIREMENTS. |
---|
35 | 37 | | (a) A community-based, nonprofit organization may apply to the |
---|
36 | 38 | | commission to receive money under the grant program if the |
---|
37 | 39 | | organization: |
---|
38 | 40 | | (1) is headquartered in Texas; |
---|
39 | 41 | | (2) provides a child-centered strategy that is |
---|
40 | 42 | | available to each child in the identified region; |
---|
41 | 43 | | (3) demonstrates a current and valid data-sharing |
---|
42 | 44 | | agreement with a state agency; |
---|
43 | 45 | | (4) demonstrates municipal and/or county support for |
---|
44 | 46 | | program and agreement to coordinate with grantee to administer |
---|
45 | 47 | | program; |
---|
46 | 48 | | (5) possess current and valid authorization to provide |
---|
47 | 49 | | services to children in foster care; |
---|
48 | 50 | | (6) use generally accepted statistical methods to |
---|
49 | 51 | | demonstrate services provide a positive impact on the well-being of |
---|
50 | 52 | | children in program, and successfully prevent incidences of abuse |
---|
51 | 53 | | and neglect; |
---|
52 | 54 | | (7) uses a generally accepted psychological |
---|
53 | 55 | | assessment before providing services and upon program completion to |
---|
54 | 56 | | demonstrate a positive impact on the well-being and mental health, |
---|
55 | 57 | | of children served; and |
---|
56 | 58 | | (8) use a generally accepted psychological assessment |
---|
57 | 59 | | before providing services and upon program completion to |
---|
58 | 60 | | demonstrate a positive impact on the well-being and mental health, |
---|
59 | 61 | | of children served; and |
---|
60 | 62 | | (9) submit an annual report to HHSC providing |
---|
61 | 63 | | information on program participant outcomes, and recommendations |
---|
62 | 64 | | for best-practice prevention strategies for consideration in other |
---|
63 | 65 | | regions in the state. |
---|
64 | 66 | | (b) The commission may award grants under the grant program |
---|
65 | 67 | | to eligible applicants. |
---|
66 | 68 | | Sec. 264.1694. FUNDING. (a) The commission shall award |
---|
67 | 69 | | grants under the program in accordance with this chapter from money |
---|
68 | 70 | | appropriated for the purposes of the program. |
---|
69 | 71 | | (b) Out of money appropriated to the commission that is |
---|
70 | 72 | | available for the purpose, the commission shall allocate a minimum |
---|
71 | 73 | | of $10 million each fiscal biennium to award grants under this |
---|
72 | 74 | | subchapter. |

74 | 76 | | Sec. 264.1695. RULES. The executive commissioner shall |
---|
75 | 77 | | adopt rules to implement this chapter. |
---|
76 | 78 | | SECTION 2. Not later than January 1, 2026, the executive |
---|
77 | 79 | | commissioner of the Health and Human Services Commission shall |
---|
78 | 80 | | adopt the rules necessary to implement Chapter , Code, as |
---|
79 | 81 | | added by this Act. |

80 | 82 | | SECTION 3. This Act takes effect September 1, 2025. |
