68 relating to the establishment of a child protective services
79 prevention grant program.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter B-1, Chapter 264, Family Code, is
1012 amended by adding Section 264.1691, Sec.264.1692, Sec. 264.1693,
1113 Sec. 264.1694, and Sec. 264.1695 to read as follows:
1214 Sec. 264.1691. CHILD PROTECTIVE SERVICES PREVENTION GRANT
1315 PROGRAM. In this section, (a) "community-based, nonprofit
1416 organization" means a community-driven nonprofit organization that
1517 is headquartered in Texas that provides child-centered
1618 preservation services; and
1719 (b) "Grant program" means the child protective services
1820 prevention grant program established under this subchapter.
1921 Sec. 264.1692. ESTABLISHMENT AND ADMINISTRATION OF
2022 PROGRAM. (a) The commission shall establish and administer a child
2123 protective services prevention grant program through which the
2224 commission awards grants to one or more eligible community-based,
2325 nonprofit organizations for preventing, or reducing, incidences of
2426 child abuse and neglect and promoting a child's well-being by:
2527 (1) identifying children who are most at risk for
2628 abuse and neglect before they enter child protective services,
2729 families stand the best chance at staying together, and children
2830 have the best odds for a healthy, productive, and fulfilling life.
2931 (b) The commission shall provide grants to community-based,
3032 nonprofit organizations to focused on an areas of need, not greater
3133 than one-square mile, in a county that is ranked among the five
3234 counties with the highest per capita rates of child abuse and
3335 neglect.
3436 Sec. 264.1693. APPLICATION AND ELIGIBILITY REQUIREMENTS.
3537 (a) A community-based, nonprofit organization may apply to the
3638 commission to receive money under the grant program if the
3739 organization:
3840 (1) is headquartered in Texas;
3941 (2) provides a child-centered strategy that is
4042 available to each child in the identified region;
4143 (3) demonstrates a current and valid data-sharing
4244 agreement with a state agency;
4345 (4) demonstrates municipal and/or county support for
4446 program and agreement to coordinate with grantee to administer
4547 program;
4648 (5) possess current and valid authorization to provide
4749 services to children in foster care;
4850 (6) use generally accepted statistical methods to
4951 demonstrate services provide a positive impact on the well-being of
5052 children in program, and successfully prevent incidences of abuse
5153 and neglect;
5254 (7) uses a generally accepted psychological
5355 assessment before providing services and upon program completion to
5456 demonstrate a positive impact on the well-being and mental health,
5557 of children served; and
5658 (8) use a generally accepted psychological assessment
5759 before providing services and upon program completion to
5860 demonstrate a positive impact on the well-being and mental health,
5961 of children served; and
6062 (9) submit an annual report to HHSC providing
6163 information on program participant outcomes, and recommendations
6264 for best-practice prevention strategies for consideration in other
6365 regions in the state.
6466 (b) The commission may award grants under the grant program
6567 to eligible applicants.
6668 Sec. 264.1694. FUNDING. (a) The commission shall award
6769 grants under the program in accordance with this chapter from money
6870 appropriated for the purposes of the program.
6971 (b) Out of money appropriated to the commission that is
7072 available for the purpose, the commission shall allocate a minimum
7173 of $10 million each fiscal biennium to award grants under this
7274 subchapter.

7476 Sec. 264.1695. RULES. The executive commissioner shall
7577 adopt rules to implement this chapter.
7678 SECTION 2. Not later than January 1, 2026, the executive
7779 commissioner of the Health and Human Services Commission shall
7880 adopt the rules necessary to implement Chapter , Code, as
7981 added by this Act.
8082 SECTION 3. This Act takes effect September 1, 2025.
