46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to discrimination by a state agency against an applicant
79 for or holder of an occupational license.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Chapter 57, Occupations Code, is amended by
1012 adding Subchapter D to read as follows:
1113 SUBCHAPTER D. DISCRIMINATION BY STATE AGENCY AGAINST APPLICANT OR
1214 LICENSE HOLDER
1315 Sec. 57.151. CERTAIN RULES OR POLICIES PROHIBITED. (a) A
1416 state agency that issues a license or otherwise regulates a
1517 business, occupation, or profession may not adopt any rule,
1618 regulation, or policy or impose a penalty that:
1719 (1) limits an applicant's ability to obtain, maintain,
1820 or renew a license based on a sincerely held religious belief of the
1921 applicant; or
2022 (2) burdens an applicant's or a license holder's:
2123 (A) free exercise of religion, regardless of
2224 whether the burden is the result of a rule generally applicable to
2325 all applicants or license holders;
2426 (B) freedom of speech regarding a sincerely held
2527 religious belief; or
2628 (C) membership in any religious organization.
2729 (b) Subsection (a) does not apply to the licensing or
2830 regulation of peace officers by the Texas Commission on Law
2931 Enforcement under Chapter 1701.
3032 (c) Subsection (a) does not prohibit a state agency from
3133 taking any action to ensure that the standard of care or practice
3234 for the applicable business, occupation, or profession is
3335 satisfied.
3436 (d) This section may not be construed to:
3537 (1) authorize a license holder to refuse to provide a
3638 medical service within the scope of the person's license that is
3739 necessary to prevent death or imminent serious bodily injury; or
3840 (2) limit any right, privilege, or protection granted
3941 to any person under the constitution and laws of this state and the
4042 United States.
4143 Sec. 57.152. ADMINISTRATIVE OR JUDICIAL RELIEF. (a) A
4244 person may assert that a state agency rule, regulation, or policy,
4345 or a penalty imposed by the agency, violates Section 57.151 as a
4446 defense in an administrative hearing or as a claim or defense in a
4547 judicial proceeding under Chapter 37, Civil Practice and Remedies
4648 Code, except that the person may not assert the violation as a
4749 defense to:
4850 (1) an allegation of sexual misconduct; or
4951 (2) prosecution of an offense.
5052 (b) A person may bring an action for injunctive relief
5153 against a violation of Section 57.151.
5254 SECTION 2. This Act takes effect immediately if it receives
5355 a vote of two-thirds of all the members elected to each house, as
5456 provided by Section 39, Article III, Texas Constitution. If this
5557 Act does not receive the vote necessary for immediate effect, this
5658 Act takes effect September 1, 2025.
