66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the board of directors of certain public utility
99 agencies.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 572.057, Local Government Code, is
1212 amended by amending Subsection (b) and adding Subsection (f) to
1313 read as follows:
1414 (b) Except as provided by Subsection (f), each [Each]
1515 director must be appointed by place by the governing bodies of the
1616 participating public entities. Each participating public entity is
1717 entitled to appoint at least one director.
1818 (f) In addition to the directors provided for in Subsection
1919 (b), for a public utility agency that is located both in the county
2020 that contains the Capitol, and in a county that is adjacent to the
2121 county that contains the Capitol, one director will be elected by
2222 the qualified voters of the respective county, for each county
2323 under this Subsection. For the purposes of this Subsection, “
2424 qualified voter” means a registered voter of the county underlying
2525 the public utility agency’s service area who resides within the
2626 service area.
2727 SECTION 2. This Act takes effect January 1, 2027.
