11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 35.004(d-2), Utilities Code, is amended | |
13 | 13 | to read as follows: | |
14 | 14 | (d-2) Costs in excess of the transmission-owning utility | |
15 | 15 | allowance provided by Subsection (d-1) incurred to interconnect | |
16 | 16 | generation resources with the ERCOT transmission system must be | |
17 | 17 | directly assigned to and collected from the generation resource | |
18 | 18 | interconnecting through the facilities. This subsection does not | |
19 | 19 | apply to excess costs incurred to interconnect a generation | |
20 | 20 | resource that is an advanced nuclear reactor. For purposes of this | |
21 | 21 | subsection, an advanced nuclear reactor is a fission-based reactor | |
22 | 22 | belonging to one of the following categories: | |
23 | 23 | (1) a large reactor, with a generation capacity | |
24 | 24 | between 400 and 1400 megawatts of electricity; | |
25 | 25 | (2) a small modular reactor, with a generation | |
26 | 26 | capacity between 50 and 400 megawatts of electricity; or | |
27 | 27 | (3) a microreactor, with a generation capacity of less | |
28 | 28 | than 50 megawatts of electricity. | |
29 | 29 | SECTION 2. This Act takes effect September 1, 2025. |
