46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the authority of a political subdivision to use public
79 money to provide legal services for individuals unlawfully present
810 in the United States.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Chapter 140, Local Government Code, is amended
1113 by adding Section 140.014 to read as follows:
1214 Sec. 140.014. PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE
1315 LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required
1416 by the United States Constitution, a political subdivision may not:
1517 (1) use public money to provide legal services for an
1618 individual who is unlawfully present in the United States according
1719 to the terms of the federal Immigration and Nationality Act (8
1820 U.S.C. Section 1101 et seq.); or
1921 (2) provide public money to a person to be used to
2022 directly or indirectly provide legal services for an individual
2123 described by Subdivision (1).
2224 SECTION 2. This Act takes effect September 1, 2025.
