| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 22.003, Education Code, is amended by |
|---|
| 9 | 11 | | adding Subsection (g) to read as follows: |

| 10 | 12 | | (g) The accrued sick leave days of an employee of a school |
|---|
| 11 | 13 | | district or charter school, upon retirement, shall be transferred |
|---|
| 12 | 14 | | into a sick leave bank. This bank may be used by any school district |
|---|
| 13 | 15 | | or charter school employee who has exhausted their granted sick |
|---|
| 14 | 16 | | leave days, subject to any existing policies implemented by the |
|---|
| 15 | 17 | | school district or charter school. |
|---|
| 16 | 18 | | SECTION 2. This section shall not preempt any existing |
|---|
| 17 | 19 | | policies of a public school district or charter school regarding |
|---|
| 18 | 20 | | the disbursement of accumulated sick days of retired employees. |
|---|
| 19 | 21 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 20 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 24 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 25 | | Act takes effect September 1, 2025. |
