88 AN ACT
99 relating to boil water notices issued by public drinking water
1010 supply systems.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 341, Health and Safety
1313 Code, is amended by adding Section 341.043 to read as follows:
1414 Sec. 341.043. BOIL WATER NOTICES. (a) The commission shall
1515 require an operator of a public drinking water supply system to
1616 issue a boil water notice not later than 12 hours after the public
1717 drinking water supply system learns of:
1818 (1) a violation by the system of rules adopted by the
1919 commission under this subchapter that creates a significant
2020 potential for human health to be seriously adversely affected; or
2121 (2) a situation that creates a significant potential
2222 for human health to be adversely affected by water from the system.
2323 (b) If the violation or situation has not been resolved 48
2424 hours after the boil water notice was issued, the public drinking
2525 water supply system shall reissue the boil water notice with a
2626 statement describing the actions the public drinking water supply
2727 system is taking to address the violation or situation.
2828 (c) A public drinking water supply system may issue a boil
2929 water notice by any means of direct communication that meets the
3030 requirements of the federal Safe Drinking Water Act (42 U.S.C.
3131 Section 300f et seq.).
3232 SECTION 2. This Act takes effect September 1, 2025.
