11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter C, Chapter 341, Health and Safety | |
13 | 13 | Code, is amended by adding Section 341.043 to read as follows: | |
14 | 14 | Sec. 341.043. BOIL WATER NOTICES. (a) The commission shall | |
15 | 15 | require an operator of a public drinking water supply system to | |
16 | 16 | issue a boil water notice not later than 12 hours after the public | |
17 | 17 | drinking water supply system learns of: | |
18 | 18 | (1) a violation by the system of rules adopted by the | |
19 | 19 | commission under this subchapter that creates a significant | |
20 | 20 | potential for human health to be seriously adversely affected; or | |
21 | 21 | (2) a situation that creates a significant potential | |
22 | 22 | for human health to be adversely affected by water from the system. | |
23 | 23 | (b) If the violation or situation has not been resolved 48 | |
24 | 24 | hours after the boil water notice was issued, the public drinking | |
25 | 25 | water supply system shall reissue the boil water notice with a | |
26 | 26 | statement describing the actions the public drinking water supply | |
27 | 27 | system is taking to address the violation or situation. | |
28 | 28 | (c) A public drinking water supply system may issue a boil | |
29 | 29 | water notice by any means of direct communication that meets the | |
30 | 30 | requirements of the federal Safe Drinking Water Act (42 U.S.C. | |
31 | 31 | Section 300f et seq.). | |
32 | 32 | SECTION 2. This Act takes effect September 1, 2025. |
