57 AN ACT
68 relating to the authority of an emergency services district to
79 provide preventive health care services.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter C, Chapter 775, Health and Safety
1012 Code, is amended by adding Section 775.0311 to read as follows:
1113 Sec. 775.0311. PREVENTIVE HEALTH CARE SERVICES. (a) This
1214 section applies to a district that is licensed as or contracts with:
1315 (1) an emergency medical services provider under
1416 Chapter 773; or
1517 (2) a first responder organization under Chapter 773.
1618 (b) In this section, "preventive health care services"
1719 means out-of-hospital routine health care services, including
1820 immunizations, screenings, checkups, and patient counseling,
1921 provided for the purpose of preventing illness, disease, or other
2022 health problems.
2123 (c) A district may provide preventive health care services
2224 to reduce reliance on 9-1-1 transports and systems for routine
2325 health care and contract with the state or a local government, as
2426 provided by Section 775.0366, to provide those services.
2527 (d) A reference in this chapter to the district providing
2628 emergency services includes preventive health care services.
2729 (e) A district may make necessary improvements and adopt
2830 rules and regulations for the purposes of this section.
2931 (f) A district in a county with a population of less than
3032 60,000 must obtain approval from the county commissioners court
3133 prior to providing services under this section.
3234 SECTION 2. This Act takes effect immediately if it receives
3335 a vote of two-thirds of all the members elected to each house, as
3436 provided by Section 39, Article III, Texas Constitution. If this
3537 Act does not receive the vote necessary for immediate effect, this
3638 Act takes effect September 1, 2025.
