46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to electioneering near a polling place; creating a
79 criminal offense.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 61.003, Election Code, is amended by
1012 amending Subsection (a) and adding Subsection (a-2) to read as
1113 follows:
1214 (a) A person commits an offense if, during the voting period
1315 and within 100 feet of an outside door through which a voter may
1416 enter the building in which a polling place is located and is
1517 designated by the presiding judge as the single point of entry, the
1618 person:
1719 (1) loiters; or
1820 (2) electioneers for or against any candidate,
1921 measure, or political party.
2022 (a-2) A person commits an offense if, during the voting
2123 period, the person prohibits electioneering outside the area
2224 described in Subsection (a), including electioneering outside that
2325 area and on the premises of a building in which a polling place is
2426 located.
2527 SECTION 2. Section 61.010(a), Election Code, is amended to
2628 read as follows:
2729 (a) Except as provided by Subsection (b), a person may not
2830 wear a badge, insignia, emblem, or other similar communicative
2931 device relating to a candidate, measure, or political party
3032 appearing on the ballot, or to the conduct of the election, in the
3133 polling place or within 100 feet of the [any] outside door through
3234 which a voter may enter the building in which the polling place is
3335 located designated by the presiding judge as the single point of
3436 entry under Section 61.003(a).
3537 SECTION 3. Section 62.013(a), Election Code, is amended to
3638 read as follows:
3739 (a) An election officer commits an offense if the officer
3840 knowingly posts at a polling place, including the area within 100
3941 feet of an outside door through which a voter may enter the building
4042 in which the polling place is located designated by the presiding
4143 judge as the single point of entry under Section 61.003(a), a sign,
4244 card, poster, or other similar material that:
4345 (1) is not authorized or required by law; or
4446 (2) is in a form or contains information that is not
4547 authorized or required by law.
4648 SECTION 4. Section 85.036(a), Election Code, is amended to
4749 read as follows:
4850 (a) During the time an early voting polling place is open
4951 for the conduct of early voting, a person may not electioneer for or
5052 against any candidate, measure, or political party in or within 100
5153 feet of an outside door through which a voter may enter the building
5254 or structure in which the early voting polling place is located and
5355 is designated by the presiding judge as the single point of entry
5456 under Section 61.003(a).
5557 SECTION 5. This Act takes effect September 1, 2025..
