8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 61.003, Election Code, is amended by |
---|
10 | 12 | | amending Subsection (a) and adding Subsection (a-2) to read as |
---|
11 | 13 | | follows: |
---|
12 | 14 | | (a) A person commits an offense if, during the voting period |
---|
13 | 15 | | and within 100 feet of an outside door through which a voter may |
---|
14 | 16 | | enter the building in which a polling place is located and is |
---|
15 | 17 | | designated by the presiding judge as the single point of entry, the |
---|
16 | 18 | | person: |
---|
17 | 19 | | (1) loiters; or |
---|
18 | 20 | | (2) electioneers for or against any candidate, |
---|
19 | 21 | | measure, or political party. |
---|
20 | 22 | | (a-2) A person commits an offense if, during the voting |
---|
21 | 23 | | period, the person prohibits electioneering outside the area |
---|
22 | 24 | | described in Subsection (a), including electioneering outside that |
---|
23 | 25 | | area and on the premises of a building in which a polling place is |
---|
24 | 26 | | located. |
---|
25 | 27 | | SECTION 2. Section 61.010(a), Election Code, is amended to |
---|
26 | 28 | | read as follows: |
---|
27 | 29 | | (a) Except as provided by Subsection (b), a person may not |
---|
28 | 30 | | wear a badge, insignia, emblem, or other similar communicative |
---|
29 | 31 | | device relating to a candidate, measure, or political party |
---|
30 | 32 | | appearing on the ballot, or to the conduct of the election, in the |
---|
31 | 33 | | polling place or within 100 feet of the [any] outside door through |
---|
32 | 34 | | which a voter may enter the building in which the polling place is |
---|
33 | 35 | | located designated by the presiding judge as the single point of |
---|
34 | 36 | | entry under Section 61.003(a). |
---|
35 | 37 | | SECTION 3. Section 62.013(a), Election Code, is amended to |
---|
36 | 38 | | read as follows: |
---|
37 | 39 | | (a) An election officer commits an offense if the officer |
---|
38 | 40 | | knowingly posts at a polling place, including the area within 100 |
---|
39 | 41 | | feet of an outside door through which a voter may enter the building |
---|
40 | 42 | | in which the polling place is located designated by the presiding |
---|
41 | 43 | | judge as the single point of entry under Section 61.003(a), a sign, |
---|
42 | 44 | | card, poster, or other similar material that: |
---|
43 | 45 | | (1) is not authorized or required by law; or |
---|
44 | 46 | | (2) is in a form or contains information that is not |
---|
45 | 47 | | authorized or required by law. |
---|
46 | 48 | | SECTION 4. Section 85.036(a), Election Code, is amended to |
---|
47 | 49 | | read as follows: |
---|
48 | 50 | | (a) During the time an early voting polling place is open |
---|
49 | 51 | | for the conduct of early voting, a person may not electioneer for or |
---|
50 | 52 | | against any candidate, measure, or political party in or within 100 |
---|
51 | 53 | | feet of an outside door through which a voter may enter the building |
---|
52 | 54 | | or structure in which the early voting polling place is located and |
---|
53 | 55 | | is designated by the presiding judge as the single point of entry |
---|
54 | 56 | | under Section 61.003(a). |
---|
55 | 57 | | SECTION 5. This Act takes effect September 1, 2025.. |
