138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. Subchapter A, Chapter 34, Utilities Code, is
1510 amended by adding Section 34.01051 to read as follows:
16- Sec. 34.01051. ENERGY EFFICIENCY GRANTS. (a) The

1712 commission may use money in the fund without further appropriation
18- to provide grants for energy efficiency projects that benefit
19- retail electric customers, including residential weatherization,

29- SECTION 2. This Act takes effect January 1, 2026, but only

25+ SECTION 2. Section 34.0106(c), Utilities Code, is amended
26+ to read as follows:
27+ (c) The commission shall require each recipient of a loan
28+ under this chapter to enter into a debt covenant that requires the
29+ recipient to meet facility performance standards adopted by the
30+ commission. The commission by rule shall adopt performance
31+ standards for the purposes of this subsection based on reliability
32+ metrics appropriate for the types of facilities for which loans may
33+ be provided. This subsection does not apply to a loan or grant
34+ provided under Section 34.01051.
35+ SECTION 3. This Act takes effect January 1, 2026, but only
3036 if the constitutional amendment proposed by the 89th Legislature,
3137 Regular Session, 2025, authorizing the use of money in the Texas
3238 energy fund for energy efficiency projects that benefit retail
3339 electric customers is approved by the voters. If that amendment is
3440 not approved by the voters, this Act has no effect.
