68 Relating to the creation of the Texas Commission on Public School
79 Teacher Retirement Funding Transparency.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Chapter 48, Education Code, is amended by adding
1012 Subchapter H to read as follows:
1113 SUBCHAPTER H. TEXAS COMMISSION ON PUBLIC SCHOOL TEACHER RETIREMENT
1214 FUNDING TRANSPARENCY
1315 Sec. 48.401. DEFINITION. In this subchapter, "commission"
1416 means the Texas Commission on Public School Teacher Retirement
1517 Funding Transparency.
1618 Sec. 48.402. TEXAS COMMISSION ON PUBLIC SCHOOL TEACHER
1719 RETIREMENT FUNDING TRANSPARENCY. (a) The commission is
1820 established to develop and make recommendations regarding methods
1921 of incorporating state resources for teacher retirement within the
2022 Foundation School Program, aligning staffing incentives with state
2123 priorities, and providing uniformity in resourcing retirement
2224 obligations.
2325 (b) The commission is composed of seven members, appointed
2426 as follows:
2527 (1) one member appointed by the governor;
2628 (2) three members appointed by the lieutenant
2729 governor; and
2830 (3) three members appointed by the speaker of the
2931 house of representatives.
3032 (c) The members appointed by:
3133 (1) the governor must have an interest in staffing
3234 issues faced by public schools;
3335 (2) the lieutenant governor must be three members of
3436 the senate; and
3537 (3) the speaker of the house of representatives must
3638 be three members of the house of representatives.
3739 Sec. 48.403. PRESIDING OFFICER. The governor shall
3840 designate the presiding officer of the commission.
3941 Sec. 48.404. COMPENSATION AND REIMBURSEMENT. A member of
4042 the commission is not entitled to compensation for service on the
4143 commission but is entitled to reimbursement for actual and
4244 necessary expenses incurred in performing commission duties.
4345 Sec. 48.405. ADMINISTRATIVE SUPPORT AND FUNDING. (a) The
4446 agency shall provide administrative support for the commission.
4547 (b) The Teacher Retirement System and the office of the
4648 comptroller of public accounts shall provide support required by
4749 the commission.
4850 (c) Funding for the administrative and operational expenses
4951 of the commission shall be provided by legislative appropriation
5052 made to the agency for that purpose.
5153 Sec. 48.406. RECOMMENDATIONS. (a) The commission shall
5254 develop recommendations under this subchapter regarding:
5355 (1) incorporating current and future appropriations
5456 for state contributions for retirement of public education
5557 personnel into the Foundation School Program as part of the basic
5658 allotment or another formula mechanism;
5759 (2) reviewing state and school contribution
5860 requirements to ensure:
5961 (A) staffing incentives prioritize classroom
6062 instruction; and
6163 (B) uniformity in retirement obligations between
6264 public schools; and
6365 (3) employer contribution requirements are sufficient
6466 to ensure the long term health of the Teacher Retirement System of
6567 Texas.
6668 (b) The commission may establish one or more working groups
6769 composed of not more than three members of the commission to study,
6870 discuss, and address specific policy issues and recommendations to
6971 refer to the commission for consideration.
7072 Sec. 48.407. REPORT. Not later than December 31, 2026, the
7173 commission shall prepare and deliver a report to the governor and
7274 the legislature that recommends statutory changes to implement
7375 recommendations under this subchapter.
7476 Sec. 48.408. PUBLIC MEETINGS AND PUBLIC INFORMATION. (a)
7577 The commission may hold public meetings as needed to fulfill its
7678 duties under this subchapter. As an advisory body, the commission
7779 is not subject to Chapter 551, Government Code.
7880 (b) The commission is subject to Chapter 552, Government
7981 Code.
8082 Sec. 48.409. COMMISSION ABOLISHED; EXPIRATION OF
8183 SUBCHAPTER. The commission is abolished and this subchapter
8284 expires January 1, 2027.
8385 SECTION 2. This Act takes effect September 1, 2025.
