11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 153.002, Family Code, is amended to read | |
13 | 13 | as follows: | |
14 | 14 | Sec. 153.002. BEST INTEREST OF CHILD. The best interest of | |
15 | 15 | the child shall always be the primary consideration of the court in | |
16 | 16 | determining the issues of conservatorship and possession of and | |
17 | 17 | access to the child, including in a suit affecting the parent-child | |
18 | 18 | relationship filed by a governmental entity under Subtitle E. | |
19 | 19 | SECTION 2. Section 153.002, Family Code, as amended by this | |
20 | 20 | Act, is intended only to clarify existing law with respect to the | |
21 | 21 | court's consideration of the best interest of the child in a suit | |
22 | 22 | affecting the parent-child relationship filed by a governmental | |
23 | 23 | entity under Subtitle E, Title 5, Family Code. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2025. |
